A copy of all data related to citations for marijuana possession on the state and local levels. I am specifically seeking records from January 2011 through December 2014.

The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, and is not being made for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

I have reviewed your request (see below) and have determined that we do not maintain a "record," per se, of the information you have requested. For that reason, your request filed pursuant to the "Alabama Open Records Act" is denied.

However, it is possible that a record containing the data you seek could be compiled for you from data stored in our database, pursuant to Rule 33, Alabama Rules of Judicial Administration.

Barring a VERY good reason, preapproved by our Director, you will have to prepay our programmers' estimated costs (@ $125 per hour) before work can commence.

Hi, Evan.

Because this job is personal to you and the $125 hourly rate is the rate that was established by our Director, pursuant to Rule 33, ARJA, which authorizes same. The rationale is that while our programmer is working for you, you should pay him.

My suspicion is that you won’t have to pay it, because as Rule 33 also states, the ONLY way to access electronic court records stored in our database is through alacourt.com our online contractor/source. We might be able to provide you a listing of case numbers created as a result of the arrests you inquired about, but we cannot provide you access to the trial court record without “going through” alacourt.com .

Our programmer has estimated that two hours’ time ($125 per hour), a total of $250 dollars, will be needed to create and complete your job.

If you still desire the data please let me know and I will process page 2 of the Form C-75 for our Director’s approval.
