For example, documents with that term from the period prior to Jeff Adachi's death could relate to routine administrative and budget matters relating to the Office of the Public Defender that do not relate to the investigation you reference in the balance of your request.

Please consider excluding the terms "Public Defender" and "Adachi" from your request so that we may focus our efforts and yours on the documents in which you are interested.

As you probably expect, I continue to object to all exclusion of headers/metadata (including, but not limited to withholding city employee email addresses in the from/to/cc/bcc), failure to provide native formats, failure to provide textual PDFs, failure to preserve color, hyperlinks, and other formatting from original records by printing and scanning in black and white, and thus an overall failure to provide exact copies. Some, but not all, of these issues should be adjudicated before the Oct. 2 SOTF en banc hearing as you also are well aware. Please do not destroy original records to avoid production under SOTF, Court, or Supervisor of Records order.

This is a request for a 7-day 67.21(c) statement for quantity, nature, form, and existence of each request made on Sept. 11. In addition for the Mayor, I would like a separate statement for each of each her official email addresses - there is evidence that she has at least 2 of them. Also, as a reminder I made separate requests for personal accounts vs govt accounts - so I expect distinct 67.21(c) statements for them. If you would like me to rewrite each as a question, I am happy to do so.

Re: keywords - While you are not permitted to discriminate based on the purpose of my request, I will volunteer that part of my purpose is to investigate whether the Mayor's office knew or should have known about any concerns with Mr. Adachi prior to his death (not just the Carmody raid), and whether there are or were any political maneuverings by the Mayor's office regarding the role of the public defender before or after his death. Therefore the keywords "adachi" and "public defender" are crucial and I will not exclude them.

Is this request complete? I've gotten only 69 pages of records for one of the most newsworthy incidents in recent SF history, and haven't heard anything in a month. Rolling responses were required. I will be beginning the appeals process.

Again, we know your office knows how to produce records in at least PDF text format with redactions, since you have done it many other times and physical printing serves solely to obfuscate the record and is not an exact copy of the record.

Nope. OCR will also be appealed. There is no reason not to convert directly from Outlook to a text PDF and redact in Adobe. The City (and I believe your office itself) has done this in the past. No chance SOTF is going to hold even mere conversion to PDF is not an easily generated format. Your Office is just trying to make life difficult for requestors at this point and all withholdings and incorrect productions will be appealed to the end.

For example, by printing and using OCR you have unlawfully withheld without justification the following in this collection:
- dozens of hyperlinks on pg 67-77
- tweet link pg 55
- the possible link on pg 3
(also the metadata, but that is a separate issue).
I have no obligation to have to tell you about these individually. I requested the full email originally.
Furthermore printing and scanning is not an exact copy (GC 6253(b)) of the original record.

The complaint in this case will be filed tomorrow as I have various other appeals to work on today.

Separately the lack of BCC on pg 45 will be used as further evidence for why lack of metadata unlawfully withholds public information unrelated to computer encoded data.

For a total of approx. 175 pages, it has been many months now.
If no answer is forthcoming, I will be filing the complaint after close of business today.

(When I say complete I mean in full compliance with the Sunshine Ordinance:
- all records provided - SFAC 67.21(b),
- minimally withheld -67.26,
- all information (whether a full record or a part) that is withheld justified in writing by specific provisions of law -67.27,
- every maskings/deletions/segregation keyed by a clear reference or a footnote to the associated justification(s) -67.26,
- no exemption justifications are prohibited in the City -67.24/67.27,
- all easily generated formats requested provided -67.21(l),
- determinations of whether or not you had records and whether you withheld any -Gov Code 6253(c))

As a reminder I asked for searches of chat/text/etc. apps including personal, which will likely contain some of the most interesting material (if there is any). I have received no determination of whether such records exists.

This is not just unlawful under SFAC 67.21(l) as a matter of principle - I'd argue its not even a copy of the record under SFAC 67.21(b), as the record is being ruined. What happened to using PDFMaker?

Is your office still taking the position that physically printing and scanning emails (even with OCR) is lawful under the Sunshine Ordinance? Indeed, you don't have to answer the question in writing, but if you don't, I have to file ever more complaints as that is the only way things appear to get resolved. I *know* for certain that you know how to use PDFMaker and give me the much closer to exact copy PDFs that it makes.

3. Is your response complete now? What happened to the personal account searches and text/chat/SMS/app searches? If there are no responsive records on those please represent as such. Obviously there *were* such messages you gave within these attachments to other persons....

This is a follow up to a previous request:

Can you please indicate whether your response to this request is complete?
For a total of approx. 175 pages, it has been many months now.
If no answer is forthcoming, I will be filing the complaint after close of business today.

(When I say complete I mean in full compliance with the Sunshine Ordinance:
- all records provided - SFAC 67.21(b),
- minimally withheld -67.26,
- all information (whether a full record or a part) that is withheld justified in writing by specific provisions of law -67.27,
- every maskings/deletions/segregation keyed by a clear reference or a footnote to the associated justification(s) -67.26,
- no exemption justifications are prohibited in the City -67.24/67.27,
- all easily generated formats requested provided -67.21(l),
- determinations of whether or not you had records and whether you withheld any -Gov Code 6253(c))

As a reminder I asked for searches of chat/text/etc. apps including personal, which will likely contain some of the most interesting material (if there is any). I have received no determination of whether such records exists.

This is not just unlawful under SFAC 67.21(l) as a matter of principle - I'd argue its not even a copy of the record under SFAC 67.21(b), as the record is being ruined. What happened to using PDFMaker?

Is your office still taking the position that physically printing and scanning emails (even with OCR) is lawful under the Sunshine Ordinance? Indeed, you don't have to answer the question in writing, but if you don't, I have to file ever more complaints as that is the only way things appear to get resolved. I *know* for certain that you know how to use PDFMaker and give me the much closer to exact copy PDFs that it makes.

3. Is your response complete now? What happened to the personal account searches and text/chat/SMS/app searches? If there are no responsive records on those please represent as such. Obviously there *were* such messages you gave within these attachments to other persons....

I understand that you claim that you are not *intentionally* withholding it, but you are nevertheless, withholding it, and your present justifications cannot cover BCC recipients. This is of course why I will continue to completely pursue all headers - government officers cannot be allowed to communicate in secret. 1. You continue to produce emails in printing and scanning fashion to me.
2. I have examined the Office of the Mayor's response to certain other requesters as well where you continue to do the same thing (printing and scanning) even though you know it unlawfully withholds certain information and is not a copy of the record.

By printing and scanning, your office continues to intentionally deprive both me and others of the color, formatting, BCCs, hyperlinks, and even just the text of emails (not to mention the headers) in a way that is neither a copy of the electronic record nor a minimal withholding.

We will be filing complaints for each and every request made to the Office of the Mayor until you stop your unlawful practice of withholding more than minimal portions and making actual electronic copies of emails.
