Pursuant to the Illinois Freedom of Information Act., I hereby request the following records:

For students that submitted school preferences for enrollment in high school for the 2022-2023 school year in the GoCPS system, please provide records sufficient to indicate

* the school and program that the student was accepted into for the 2022-2023 school year
* the Tier of the student
* if the student was admitted to a SEHS school, please provide their academic point scores with the SEHS Test component
* if the student was admitted to a choice program, please provide the academic point scores without the SEHS Test component

If fewer than five students from a Tier level went to a particular high school program, please suppress the student's point scores.

In order to reduce identifying information, please round academic scores to the nearest 10. For example, if a student scores a "751" please report "750." If a student scores a "755", please round to "760." This suggested rounding should not be construed as a request to create new records, but an option that CPS may consider.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Chicago Public Schools (CPS) responds to all public records requests in accordance with the Illinois Freedom of Information Act (FOIA), 5 ILCS 140/1 et seq.
If further time is needed to assemble and copy all documents responsive to your FOIA request, we will contact you with a time estimate and a request to extend.

RESPONSE : The Chicago Public Schools (CPS) FOIA Office has reviewed this request with the CPS Office of Access and Enrollment and has been advised that the current GoCPS offer/admission cycle is still ongoing and therefore finalized data is not yet available. As this data is still being collected and reconciled with planning decisions for the upcoming school year on a rolling basis, it is currently exempt from disclosure pursuant to section 7(1)(f) of the FOIA. Section 7(1)(f) which exempts from release “[p]reliminary drafts, notes, recommendations, memoranda and other records in which opinions are expressed, or policies or actions are formulated, except that a specific record or relevant portion of a record shall not be exempt when the record is publicly cited and identified by the head of the public body.” 5 ILCS 140/7 (1)(f). The exemption includes “purely factual information” where it is “inextricably intertwined” with predecisional discussions. Watkins v. McCarthy, 980 N.E.2d 733, 743 (2012) (quoting Enviro Tech International, Inc. v. United States Environmental Protection Agency, 371 F.3d 370, 374-75 (7 th Cir. 2004). Accordingly, you may wish to submit this request at a later date after the upcoming school year has begun. In the event of a denial, pursuant to 5 ILCS 140/9.5(a) you may file a Request for Review with the Public Access Counselor (PAC) at: Public Access Counselor; Office of the Attorney General; 500 South 2nd Street; Springfield, IL 62706.  You also have the right to seek judicial review of your denial by filing a lawsuit in the State circuit court; 5 ILCS 140/11.
