Your Freedom of Information Law (FOIL) request for "the last approved bid submission documents and executed contract associated with . . . Contract ID: CT100320181418289" is granted in part and denied in part. Your request for the executed contract number 20181418289 is granted. Your request for "the last approved bid submission documents" is denied because it fails to reasonably describe the records sought. N.Y. Public Officers Law § 89(3)(a) requires that a FOIL request "reasonably describe" the records sought. To deny a request on the ground that it fails to reasonably describe the requested records, an agency must establish that "the descriptions were insufficient for purposes of locating and identifying the documents sought." Konigsberg v. Coughlin, 68 N.Y.2d 245, 249 (1986). Your request is "insufficient for the purposes of locating and identifying the records sought." Id. It is not clear which bid documents would or would not be "last approved." Nevertheless, I am providing you with a copy of all bid related documents that are in the agency's possession just in case these documents are responsive to your request. If you seek additional bid related documents, you should consider submitting a request to the Board of Elections.
