State Budget Office within the RI Department of Administration, in which
you stated: “….. I hereby request the following records: A

On that same day, you emailed a similar request to the RI Department of
Business Regulation and to the RI Department of Transportation.
Your request was submitted pursuant to the Access to Public Records Act
contained in RIGL section 38-2-1 et seq. (the “Act”), and I have been
asked to respond to your requests on behalf of all Department of
Administration (“Department”), and the RI Department of Business
Regulation and the RI Department of Transportation.
To assist you with your requests, I sent you an email on June 11,
2014, in which I stated: Shawn, Before I can respond on behalf of RI
executive agencies, I need to talk with you. Please call me at
401-222-3417. Thanks, Peter Having not received a reply, I now send
you a formal response to your several requests.
In response to a request for records, an agency such as the Department
is required to make available for public disclosure those records that
are responsive to a request, are in the possession of the agency and are
not otherwise exempted from disclosure by the Act. Moreover, the Act
states in section 38-2-3 (h) as follows: Nothing in this section shall
be construed as requiring a public body to reorganize, consolidate, or
compile data not maintained by the public body in the form requested at
the time the request to inspect the public records was made except to
the extent that such records are in an electronic format and the public
body would not be unduly burdened in providing such data.
The RI Department of Administration does not maintain a record showing
all employees who received payout upon leaving state service in 2013, as
well as what those payouts were. Based on the information I have
received, the Department of Business Regulation and the Department of
Transportation do not maintain such a record.
The Department’s Office of Accounts and Controls electronically
maintains a file which sets forth the gross salary of state employees.
However, this file does not set forth the names of employees who
“received payout upon leaving state service in 2013, as well as what
those payouts were”. Any such information would have to be manually
retrieved from various databases. Given that approximately 400
state employees annually retire from state service each year and that
many other employees leave for other reasons, manually attempting to
consolidate the information you seek would be unduly burdensome.
While we do not possess or maintain the record that you seek, you may
wish review the information contained in the State Transparency Portal.

agency. According to DOA records, there are in excess of 400
employees who might meet the criteria you set forth. Calculating such
amounts would be labor intensive. Moreover, the "payout" for
retirees differs from the payout for employees who did not retire.

Dear Shawn,

In response to the two spreadsheets you sent on June 25, the
Department of Administration does not prescribe administrative
practices of the Rhode Island General Assembly, a separate branch of
state government. Nor does the Department of Administration prescribe
the administrative practices of the Rhode Island Public Transit
Authority, which is subject to a board consisting of eight statutory
members.

To reiterate my response dated June 23, the Department does not possess
or maintain documents in the form that you sought in your request dated
June 9, 2014. I responded to this request via email on June 23, 2014.


To help you obtain a better understanding of severance payouts that
were made on behalf of state employees during the 2013 calendar year,
the Department prepared a one page chart, which is enclosed within.
Although the enclosed chart contains a summary of the severance payouts
that were made each pay period for state employees in calendar year
2013, it does not include the names of the employees to whom the
payments were made.

As indicated in the chart, for the approximately 14, 000 state
employees, nine hundred and twenty (920) were paid severance
payments in 2013. The severance payments were made were in
accordance with the provisions of RI law. These payments included, but
were not limited to, certain unused vacation hours and certain
unused sick hours.

I will be out of the office for most days through July 27. If you have
any questions, I will get back to you during the week of July 28.

My communications with a number of departments – including the
Department of Transportation and the Department of Business
Regulation,
as you cite – have referred my inquiry to the Department of
Administration for this information. Meanwhile, a number of smaller
departments have been able to fulfill this request. Please confirm
that
the Department of Administration does not maintain a database from
which
the information I have requested might be drawn. As I understand, such
payout data is a standard component of financial accounting.

On June 9, 2014 you sent an email to the State Controller and to the
State Budget Office within the RI Department of Administration, in
which
you stated: “….. I hereby request the following records: A
spreadsheet, database or other summary of all employees who received
payout upon leaving the agency in 2013, as well as what those payouts
were.”
On that same day, you emailed a similar request to the RI Department
of
Business Regulation and to the RI Department of Transportation.
Your request was submitted pursuant to the Access to Public Records
Act
contained in RIGL section 38-2-1 et seq. (the “Act”), and I have been
asked to respond to your requests on behalf of all Department of
Administration (“Department”), and the RI Department of Business
Regulation and the RI Department of Transportation.
To assist you with your requests, I sent you an email on June 11,
2014, in which I stated: Shawn, Before I can respond on behalf of
RI
executive agencies, I need to talk with you. Please call me at
401-222-3417. Thanks, Peter Having not received a reply, I now
send
you a formal response to your several requests.
In response to a request for records, an agency such as the Department
is required to make available for public disclosure those records that
are responsive to a request, are in the possession of the agency and
are
not otherwise exempted from disclosure by the Act. Moreover, the Act
states in section 38-2-3 (h) as follows: Nothing in this section
shall
be construed as requiring a public body to reorganize, consolidate, or
compile data not maintained by the public body in the form requested
at
the time the request to inspect the public records was made except to
the extent that such records are in an electronic format and the
public
body would not be unduly burdened in providing such data.
The RI Department of Administration does not maintain a record showing
all employees who received payout upon leaving state service in 2013,
as
well as what those payouts were. Based on the information I have
received, the Department of Business Regulation and the Department of
Transportation do not maintain such a record.
The Department’s Office of Accounts and Controls electronically
maintains a file which sets forth the gross salary of state employees.

However, this file does not set forth the names of employees who
“received payout upon leaving state service in 2013, as well as what
those payouts were”. Any such information would have to be manually
retrieved from various databases. Given that approximately 400
state employees annually retire from state service each year and that
many other employees leave for other reasons, manually attempting to
consolidate the information you seek would be unduly burdensome.
While we do not possess or maintain the record that you seek, you may
wish review the information contained in the State Transparency
Portal.
