Pursuant to the District of Columbia Freedom of Information Act of 1974, D.C. Code Ann. § 2-531 et seq. ("D.C. Act"), I hereby request the following records:

All a list of all transfers made from the Commissioner of the District of Columbia to Federal Prison Industries. According to 18 U.S. Code § 4122 (e)(2): "The Commissioner of the District of Columbia may, without exchange of funds, transfer to the Federal Prison Industries any property or equipment suitable for use in performing the functions and duties covered by an agreement entered into under subsection (e)(1) of this section." Please include all segregable data, including, but not limited to, the type of equipment transferred, the condition at time of transfer, the date on which transfer occurred, etc.

This request is being made as part of a journalistic inquiry. The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 15 business days, as the statute requires.

Good afternoon, Beryl-

This office is in receipt of your Freedom of Information Act request dated August 3, 2015. Unfortunately, your request is far too broad and I must ask that you clarify with greater specificity. Pursuant to DCMR 1-402.4, it states "a request shall reasonably describe the desired record(s). Where possible, specific information regarding names, places, events, subjects, dates, files, titles, file designation, or other identifying information shall be supplied." The District of Columbia hasn't had Commissioners since the early 1970's. I'm going to have to ask that you be a little more specific. Are you seeking those records for just that period or since that time? And for what timeframe, i.e. from this date to this date, are you requesting?

In closing, pursuant to D.C. Official Code § 2-532(c) and (d)(2), we have fifteen (15) business-days, subject to the possibility of a ten (10) business-day extension, to respond to the request as of the date of receipt of the clarifying information needed to process this request.

Hello Mr. Slattery,

Thank you very much for your message. I was at a loss for the office to which to properly refer, as the wording of the statute conflicts with the current structure of things. I am seeking those records as they are currently maintained today, preferably from the period from January 1, 2000 through today, though I would be interested in obtaining all possibly responsive records. I understand that that would require a lot of time, so if you might advise as to reasonable metrics of constraint, I would appreciate it.
