In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 3 business days, as the statute requires.
I have received your CORA request of this date directed to the Sheriff's
office. You have requested a number of documents and information, dating
from 2015 to present. Some of the information may be available from the
Sheriff's Office, but some of the information may be in the Finance
Department, and some of the information and requested reports, including
detailed usage data, may not be maintained in the normal course of
business. The Colorado Open Records Act does not require compilation of
data or reports, only public access to those records that exist. In
addition, some of the information from the Sheriff's Office may not be
available for security reasons. Nevertheless, you have requested a large
volume of documents, information and records. While Montrose County
endeavors to provide timely responses to public records requests, the
continued operation of the business of the County is our paramount
concern. Montrose County public record policies and some financial data
are available on the County's website.
Under CORA, all Colorado government records that are public records are
open for inspection by any person at reasonable times during regular
business hours of the custodian holding such public records. Pursuant to
the Montrose County public records policies, paper or electronic or
technical images of public records are available for on-site inspection by
the requestor within a reasonable time following receipt of the request.
Your request is very broad and may require review of a large volume of
records, requiring a significant amount of staff time. The County
anticipates that the minimum amount of time to prepare any responsive
records to your request to be two (2) weeks, and may increase depending on
the other demands on County staff. The research time will be charged to
you at a rate of $30 per hour after the first hour, which is free of
charge. The County anticipates that the staff time required to search
for this broad request of documents and data may take up to eighty (80)
hours of staff time. In addition, the time required for transferring the
data or records to a CD or flash drive is also charged to you. Costs of
postage and mailing will apply to any records sent by mail.
Please contact the County Manager at 970-249-7755 to advise as to how you
would like to proceed with your request, and to provide payment
information if you would like to proceed.
