Pursuant to Montana Public Records Act, Article II, § 9, I hereby request the following records:
A copy of all complaints against Bennett Braun, MD, state license number MED-PHYS-LIC-10376.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

We cannot confirm or deny the existence of complaints unless or until the screening panel finds reasonable cause to believe a violation of the laws and rules that govern the license of an individual have been violated and a Notice for proposed disciplinary actions is filed. At that time, the Notice and all other legal documents from that point forward become public record and we are able to provide copies. The license of Dr. Bennett Braun MD in Montana is currently Active and in good standing, which means no disciplinary actions have been filed against this license by the Montana Board of Medical Examiners.

Hi there,
I appreciate the reply, and apologize for taking so long to respond. Dr. Braun has been sued on multiple occasions: http://articles.latimes.com/1999/mar/07/news/mn-14693.
Because these lawsuits and the alleged incidents that led to them were outside of Montana, is it not in your purview to investigate? Do you have to receive a complaint from within your jurisdiction in order to investigate a doctor?

This is dependent on the situation, including timing of an allegation, types of allegations and/or the jurisdiction where an out-of-state complaint was filed.
