We are looking for all documents related to Modesto, California's contract with Accela to purchase Tidemark software, including the original contract, the date, implementation and maintenance costs, total cost, contract duration, and all services rendered.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 calendar days, as the statute requires.

This email is in response to your written request for public records received by the City on July 11, 2017. We are treating your request as a request for public records in accordance with California Government Code Section 6250 and following (the California Public Records Act, or "the Act"). The Act requires that public agencies make reasonably identified, non-exempt public records available for inspection or provide copies upon payment of the direct costs of duplication.
This email satisfies the City's requirement to notify you within ten (10) days whether the requested records will be disclosed. (Gov. Code 6253(c).) At this time we would like to inform you that a 14-day extension is necessary under Gov. Code section 6253(c)(1). The City has the need:

This email is in response to your written request for public records received by the City on July 11, 2017. We are treating your request as a request for public records in accordance with California Government Code Section 6250 and following (the California Public Records Act, or "the Act"). The Act requires that public agencies make reasonably identified, non-exempt public records available for inspection or provide copies upon payment of the direct costs of duplication.
The City is required to notify you within ten (10) days whether the requested records will be disclosed. (Gov. Code section 6253 (c)). On July 21, 2017, the City notified you that we would need an additional 14 days to respond pursuant to Government Code section 6253 (c). This response fulfills the City's obligations under the Act. Responsive, non-exempt public records have been recovered, and are attached.
After checking with several departments it appears that when we originally purchased Tidemark it wasn't yet owned by Accela. This was many years ago, and any correspondence would have aged out of email retention by now.
Also, in 2011 when we moved to Oracle all that history was lost. Attached is the original resolution from 1998 where the purchase was approved by City Council. Also attached are purchase orders for Tidemark. I have located a box that may possibly contain more documents, however it is located offsite, and once it is delivered I will send you any responsive documents to your public records request.

Please find attached two supplemental responsive documents to your public records request of July 11, 2017.
The City has redacted information responsive to your request pursuant to Government Code sections 6254 (c) and 6254 (k) (incorporating privacy exemptions found in the United States Constitution and Article I, section 1 of the California Constitution), which exempt certain private information from disclosure. These records are also exempt from disclosure pursuant to the "catch-all" exemption, as the public interest in nondisclosure clearly outweighs the public interest in disclosure given that the City has a reasonable expectation of privacy in financial information such as account numbers.
This completes the City's response to this public records request.
