Pursuant to the Missouri Sunshine Law and the Missouri Public Records Law, I hereby request the following records:

Copies of emails sent to, or received by, a University of Missouri employee named Melissa Click and any reporter, journalist, or other representative of the media. Please limit this request to emails that are dated between November 1 and November 15, 2015 and concern any protests taking place at the University of Missouri, including those staged by a group called “Concerned Students 1950.”

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 3 business days, as the statute requires.

This is in response to your records request for all emails to or from Melissa Click from November 1 to November 10, 2015, the date of your request. Your request has been assigned tracking #5216 and a copy is included below for reference.

The estimated cost for search, research and retrieval of the documents responsive to your request is $1,037.50. The University is not prepared to waive or reduce the cost of these incurred expenses and we would require payment in advance of production of the documents. If it appears the cost incurred will significantly exceed the estimate, we will notify you before proceeding further. Of course, if the actual cost is less than your deposit, you will be issued a refund.

If you would like for the University to complete its response, please remit a check in the amount of $1,037.50 to my attention at the address given below. The check should be made payable to "The Curators of the University of Missouri."

Thank you for our response. I have two questions:

1. Could you provide a breakdown of the costs that add up to an estimated $1,037.50?

2. Do you have a sense of why it would take 4 weeks to process this request? This seems like a simple and direct request that requires one search of emails over a short time period.

3. If I simplified my request to cover all emails received by Melissa Click between November 1 and November 15, 2015, would that decrease the estimated fee?

Mr. Trotter,

The estimate is based on 31 hours for review and redaction @ $32.26/hr. and .5 hours for IT to perform the search and extraction of the emails @ $75.00/hr. The estimated time necessary to process your request includes time needed to review the responsive e-mails for closed material. For example, since Dr. Click is a faculty member there likely will be e-mails between Dr. Click and students, which would need to be redacted or otherwise protected in compliance with the federal Family Educational Rights and Privacy Act. There also likely would be e-mails that are subject to closure under provisions of the Sunshine Law concerning personnel records. We base our estimate of the time needed to process your request on the volume of e-mails in Dr. Click’s account for the time period specified and our experience on how long it takes to review that volume of e-mails. If the date range of your request is decreased, that would decrease the estimated time to process your request. Changing the request to “all” email will not decrease the estimate as we still need to review and redact all of the emails during that time period.

Hi Ms. Barrett,

Thank you for clarifying this. My follow-up questions, then, are:

1. Does $32.26/hour represent the wage for the “lowest salaried employees capable of searching, researching, and copying the records” I requested, as the state’s open-records law mandates? (Please see: https://ago.mo.gov/missouri-law/sunshine-law/sunshine-law-faqs ) Unless I am mistaken about the necessary process, the tasks of “searching,” “researching,” and “copying,” seem to require different skill sets, and certainly not all of them require a wage of $32.26.

2. If I narrowed my request to emails received by Dr. Click that did not come from University of Missouri email addresses, would that decrease the fee?

3. If I narrowed my request to emails received by Dr. Click between November 7 and November 10 (per your suggestion), do you have a sense of what the estimated fee would be?

1. That is my salary for the review and redaction of the emails. My estimate did not say it was for searching, researching and copying.

2. We are unable to eliminate certain email addresses on a search by our IT Department.

3. If you would like to amend your request, please do so and I will calculate an estimate of costs.

This is in partial final response to your records request for emails to and from Melissa Click. Your request has been assigned tracking #5216 and a copy is included below for reference.

As I informed you previously, these emails do not completely cover the time period you requested but is one of our consolidated searches that we are able to provide without cost. This search was for emails sent to or from Melissa Click between November 9 and November 10, 2015.

Attached is one file containing the responsive documents. Although the cost of gathering these records was significant, there will be no charge for providing them. Please note that some documents and portions of documents were closed pursuant to Section 610.021(13) and (14), RSMo and the federal Family Educational Rights and Privacy Act and were withheld and redacted accordingly.

We have another consolidated search for Melissa Click emails between November 2 and November 16 that we continue to work on and anticipate being able to provide within the next month.
