Pursuant to the Missouri Sunshine Law and the Missouri Public Records Law, I hereby request the following records:

-The current memorandum of agreement (MOA) or memorandum of understanding (MOU) with the Defense Logistics Agency, Disposition Services regarding the 1033 equipment surplus program administered by the DLA Law Enforcement Support Office

-The annual inventory form required to be completed by the state coordinator of the 1033 program

According to the DLA FAQ page regarding the 1033 program, the Criminal Justice/Law Enforcement Unit is the agency in charge of coordinating the 1033 program for Missouri. See http://www.dispositionservices.dla.mil/leso/Pages/StateCoordinatorList.aspx

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

In your request below dated 8/18/14, you have requested "The annual inventory form required to be completed by the state coordinator of the 1033 program".

Each State is required to conduct an annual inventory of controlled property, but the process does not involve a "form", as has been requested. Each law enforcement agency completes the annual physical inventory for the controlled items via the online DOD system. The state is then responsible to validate and certify that the law enforcement agencies are accounting for their property in the online DOD system. There are no "forms" available to provide you as it relates to these processes.

Please clarify your request and what records you are hoping to obtain and copy all of the people on this email.

Apologies -- that was an autocorrect error on my part.

As outlined in my original request submitted at the beginning of last week, this is a request for records from the Missouri Department of Public Safety in its capacity as the state coordinator for the 1033 program. Specifically, this is a request for:

1) the inventory spreadsheet of equipment received by Missouri law enforcement agencies via the 1033 program. More than 20 states have released nearly identical spreadsheets, many of which are named "State Property Book" or something similar, without redaction or extensive review. I have attached three such spreadsheets here for reference.

2) The MOA signed between the state of Missouri and the Defense Logistics Agency that outlines the conditions of participation in the 1033 program.

Please let me know if this provides adequate clarification for moving forward with this request.

Thank you for sending the MOA and spreadsheet. I had the chance to examine both over the weekend, and it seems that several thousands entries in the spreadsheet you sent list contain simply the word "NULL" in both the law enforcement agency and the transfer date fields. Several entries also list the transfer date as 12/31/1899. Could you check these fields and resend?

I'm responding on behalf of Mike O'Connell, Communications Director for the Missouri Department of Public Safety.

The NULL represents no value in the field being queried. When property is picked up by DPS, the property automatically transfers to the possession of DPS prior to being issued/transferred to the law enforcement agency. These NULL fields represent that the property was in the possession of no agency prior to being picked up by DPS. Attached is a revised spreadsheet with those rows removed.

Any equipment that indicates an Issue/Transfer date of 1/1/1900 is believed to be a data migration issue.
