Please include all policies and procedures related to how fees are set, accrued, imposed, collected, and enforced (such as those related to per diem fees, ability to pay determinations, penalties for late or non-payment, authorization for civil or criminal action for payment enforcement, etc).
b) All reports, databases, spreadsheets, or equivalent materials regarding debts/restitution paid to or owed to this department or any facility/agency under its jurisdiction in FY2021. Please include all relevant data regarding medical and room & board costs, including the number of individuals charged for medical and room & board costs or fees and the total amount of medical and room & board fees imposed in FY2021.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

In addition, we have located Miss. Code. § 47-5-1251, which authorizes the Department of Corrections to collect room and board fees from the wages of individuals participating in the “Prison Industry Enhancement Program.” In light of this statutory evidence, can you clarify whether the Department garnishes the wages of the program’s participants for room and board fees? If so, we ask that you provide the number of individuals charged these fees, under the program Prison Industry Enhancement Program, and the total amount of these fees collected in FY21.

Code. § 47-5-1251 , which enables the department to garnish the wages of individuals participating in the Prison Industry Enhancement Program for room and board “as determined by regulations issued by the Commissioner of Corrections”. Can you confirm whether participants of the Prison Industry Enhancement Program pay room and board fees as per the aforementioned statutory evidence? If so, could you also provide us with data detailing the number of individuals charged these fees and the total amount of these fees collected in FY21?

As per our initial request, we specifically asked for clarification about whether room & board fees are deducted from the accounts of MDOC offenders. We ask that you clarify whether room & board deductions are imposed and collected under the Prison Industry Enhancement Program pursuant to Miss. Code. § 47-5-1251.
