Pursuant to the Mississippi Public Records Act, I hereby request the following records:

Records of any and all wage complaints filed against Kindred Healthcare Inc. (also doing business as "Kindred Hospitals" or "Kindred At Home"), federal tax ID number 611323993,

for the inclusive period between January 1, 2010 and July 1, 2020,

with information including the date the complaint was filed, the nature of the complaint, the amount owed to the complainant, the dates worked but not compensated, and the outcome of the complaint.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 15 business days, as the statute requires.

Dear Mr. Bittle:

This agency is in receipt of your letters dated April 6, 2021, and July 7, 2020, requesting records of any and all wage complaints against Kindred Healthcare Inc. (federal tax ID number 611323993).

We preciously responded on July 27, 2020, that Mississippi Code Annotated Section 71-5-127 is the statute controlling the release of information/documentation for this agency. After examining the statute in context of your request, it is our opinion that the information requested does not permit the release of the type of information sought without a valid subpoena for the records. Therefore, this agency must deny your request for records/information.
