To whom it may concern,

Under the Wisconsin Open Records Law, §19.31 et seq., I am requesting an opportunity to obtain copies of all correspondence between Milwaukee County Sheriff David Alexander Clarke Jr. and Presidential Candidate and President of the United States Donald J. Trump between June 16, 2015 and Sept. 1, 2017.

If there are any fees for searching or copying these records, please inform me of the cost. However, I would also like to request a waiver of all fees in that the disclosure of the requested information is in the public interest and will contribute significantly to the public’s understanding of the relationship between two prominent public officials whose decisions impact millions of Americans and residents of Milwaukee County.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes. I am a reporter with ThinkProgress, an online publication covering politics and policy in Washington, DC.

Please provide expedited processing of this request which concerns a matter of urgency. As a journalist, I am primarily engaged in disseminating information. The public has an urgent need for information because it could provide valuable insight into the decision-making and rationales behind various public policies and regulations.

I would request a response in writing, within the 5 days described by law, if you intend to deny this request. Also, if you expect a significant delay in fulfilling this request, please contact me with information about when I might expect copies of the requested records.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

If you deny any or all of this request, please cite each specific exemption you feel justifies the refusal to release the information and notify me of the appeal procedures available to me under the law.

The Milwaukee County Sheriff’s Office is in receipt of your request for “all correspondence between Milwaukee County Sheriff Clarke and President Donald Trump between 6.16.15 and 9.1.17” dated 9.1.17, assigning it our agency file #17-92034. A request of this nature is governed by Wisconsin Statutes 19.31 – 19.39 (originally passed as Wisconsin Chapter 335, Laws of 1981).

Upon inspection, a proper request under the open records statutes must be reasonably specific as to the subject matter and length of time involved. (Wis. Stat. § 19.35(1) (h). The purpose of the time and subject matter limitations is to prevent unreasonably burdening a records custodian by requiring the records custodian to spend excessive amounts of time and resources deciphering and responding to a request. (Schopper, 210 Wis. 2d at 213, 565 N.W.2d at 190; Gehl, 2007WI App 238, ¶ 17, 306 Wis. 2d 247, ¶ 17, 742 N.W.2d 530, ¶ 17). Before we can proceed with your request, please advise of the search terms, email addresses and subject matter for which you request the described records. Once we consider that scope, we will contact our Information Management Services Division (IMSD) for an estimate as to charges to conduct the requisite email searches using the names and terms provided. Please note: Costs of a computer run may be imposed on a requester as a copying fee. (Wis. Stat. § 19.35(1) (e) and (3) (a); 72 Op. Att’y Gen. 68, 70 (1983). An authority may charge a requester for any computer programming expenses required to respond to a request. WIREdata II, 2008WI 69, ¶ 107, 310 Wis. 2d 397, ¶ 107, 751 N.W.2d 736, ¶ 107. Further, an authority may require prepayment of any fees if the total amount exceeds $5.00. (Wis. Stat. § 19.35(3) (f).

Further, be advised that in the event that all or parts of your request have been denied, this determination is subject to review by Mandamus Wisconsin Statute 19.37 (1) or upon application to the Attorney General or the Milwaukee County Corporation Counsel.
