I’m writing to appeal the rejection of a public records request for “emails and other records of correspondence (including meeting notes, faxes, letters, and memos) sent to or from the following legislative member and their staff members: Rep. Michele Hoitenga (R-Manton)...from the above with the following individuals and organizations: The Center for Security Policy, Christopher Holton (Vice President of Outreach at CSP), ACT for America, American Public Policy Alliance, Stephen Gele (President of APPA).”
I’m appealing this decision on the grounds that the rejection letter stated that the reason for the rejection is that the Michigan State Legislature is exempt from the Michigan Freedom of Information Act, when it actually is not.
The legislature, under Section 15.232 Subsection 2d(ii), is subject to the Michigan FOIA which states that a public body subject to the Michigan FOIA is “An agency, board, commission, or council in the legislative branch of the state government.”
In addition, under section 15.232 Subsection 2d(iv) of the Michigan FOIA, the state legislature falls under the definition of a public body which is defined as “Any other body which is created by state or local authority or which is primarily funded by or through state or local authority.”
Finally, Jackson v. Eastern Michigan University Foundation holds that any state or local entity with the power to exercise governmental or proprietary authority qualifies as a public body.
