Pursuant to Michigan's Freedom of Information Act ("FOIA"), I hereby request the following records:

I am seeking all correspondence between Consumers Energy and the Michigan DEQ, including electronic correspondence, and all permits and permit requests submitted to the DEQ by Consumers Energy, for the areas of Ionia County.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Your FOIA request as written would require all staff to search for "all correspondence between Consumers Energy and the Michigan DEQ..." Please be advised that the estimated cost to search, retrieve and review all responsive records would cost thousands of dollars.

We are proposing the following option to reduce your costs:

Reword your request as follows: I am requesting all permits and permit requests (including all correspondence) submitted to the DEQ by Consumers Energy, for Ionia County.

This notice is issued in response to your request for information under the Freedom of Information Act, 1976 PA 442, as amended (FOIA), received on June 14, 2017. You have requested information described as: Consumers Energy all permits and permit requests and correspondence for Ionia County.

Due to time constraints and limited resources, it is necessary to issue a 10-business day extension until July 6, 2017, as permitted under Section 5(2)(d) of the FOIA.

The Michigan Department of Environmental Quality (MDEQ) receives thousands of FOIA requests annually, many of which request a waiver of fees. The MDEQ will issue a fee waiver for the first $20.00 of the fee, as required under the FOIA, for an individual who submits an affidavit that he or she receives public assistance or states facts showing an inability to pay the cost because of indigence. Although a majority of the MDEQ FOIA requests pertain to records that may be considered as primarily benefitting the general public, the MDEQ does not waive, reduce, or exempt fees solely on the basis of benefit to the public. The MDEQ must utilize our monies and resources, entrusted to us by the taxpayers, in the most efficient manner possible to carry out our mission; thus, your request for a waiver of fees has been denied.

FOIA 4326: In answer to your request for Consumers Energy Permits and Correspondence for sites in Ionia County, we can offer the following information.

This response covers three Superfund sites in Ionia County: American Anodco, H&K Sales, and Ionia City Landfill. This response does not cover other sites that may exist in Ionia County. The Project Manager for Ionia City Landfill indicated she is not aware of any information in that file relating to Consumers Energy "Permit" requests or correspondence. Consumers does have an easement along the Rails to Trails that bisects the site (a copy of that is in the files). The Administrative Record for that site is up-to-date and a copy of that can be sent. The files for Ionia City Landfill (18 boxes) are at the State Record Center. If you wish to view those files, we can order them from the Record Center.

The files for American Anodco (5 boxes) and H&K Sales (1 box) are also at the State Record Center. We do not know if there is any of the requested information in the files for these two sites. We can pull the files from the Record Center if you wish to come in to view them.

There is no charge to view the files, but charges may be involved for staff time and copying.
