A message was sent to you regarding record request #22-3689:

Thank you for your email.

Upon review of your Public Records Request, it has been determined that a search query of the City e-mail servers is the best route to locate documents responsive to your request. In compliance with the Florida Retention Schedule, City emails go back 10 years from the date the email search is run.

Because the number of emails for review depends on the search terms used, we are reaching out to request input on the search terms. Below, please find a list of information necessary for the IT Search and our suggested terms based on your request:

* Timeframe – The Start Date to End Date.

* Custodians – Identify specific individuals whose correspondence you are seeking.

* Precise Search Terms – specific terms, phrases or keywords that will be contained in the e-mail.

Please see the Search Criteria box below with our suggested inputs. These are the search terms I think you are requesting to be searched. If you wish to change these terms or propose new ones, please respond no later than cease of business 11/22/22. If you agree with the suggested inputs, please respond confirming and we will run the search as soon as possible. If we do not hear back from you by 11/22/22, the search will be run using the terms stated below.

Search Criteria:

Start Date

1/1/2021

End Date

11/14/2022

Individuals

@miamigov.com

Keywords / Phrases

("FTX” OR "FTX Trading Limited" OR “FTX.us”)

Please be advised due to the extensive use of resources such as information technology and clerical staff time entailed in an email search, the City is entitled to charge the costs incurred to run the search, review the emails for exemptions, and then produce responsive emails, if any, in accordance with Chapter 119, Florida Statutes, as amended.

If the email search yields 100 or less emails, then no fees shall be assessed. However, if the email yields more than 100 emails, a special service charge will be applied based on the City's labor costs to review the emails. An estimate will be provided based on the hourly rate of the lowest paid paralegal (currently $37.58) and an estimated review rate of 3 emails per minute.

Please be advised, that in the event the initial email search does not satisfy you, for any reason, and you request a revised search, a special service charge of $42.81 will be imposed to run a revised search.

We look forward to working with you. Please do not hesitate to contact me, with any questions, comments or concerns.

Thank you!

A message was sent to you regarding record request #22-3689:

Good afternoon:

The Department of Innovation and Technology has completed the search for the above referenced Public Records Request. The search yielded 28,958 e-mails (which may include duplicate e-mails or non-responsive e-mails to the exact request). Due to the voluminous nature of these e-mails we will need to charge a special service charge for the review and possible redactions of the e-mails prior to release to ensure compliance with Chapter 119, Florida Statutes, as amended.

Currently the rate to fulfill these requests is estimated at three (3) emails per minute. Accordingly, we estimate it will take 160.87 hours, at a rate of $37.58 to complete the review and fulfill the request. Thus, the estimated costs to produce is $6,045.78. Please be advised that this is an estimate and the cost is subject to change, as it may take less or more time to complete the review. Accordingly, we request a fifty (50%) percent deposit in the amount of $3,022.89 to begin review of the search results.

Please advise if this is acceptable and how you would like to proceed. If you elect to proceed, we will send you directions on how to pay the 50% deposit. If we do not receive a response by cease of business 1/2/23, we will consider this request withdrawn and close accordingly.

Alternatively, you may request a revised search using different search terms. Please be aware that there is a special service charge for revised searches in the amount of $42.81. Should you elect this option, we will provide a new estimate for review of the results of the revised search.

Thank you.
