Pursuant to the Virginia Freedom of Information Act, I hereby request the following records:

- A copy of any data release consent forms parents or students are asked to sign
- Any current policy documents or guidelines governing student data usage
- Any amendments made to those forms from 2015-2019
- Documents outlining any third-party programs or applications collecting student data

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Subject: FOIA Request Received February 20, 2020

Dear Mr. Nash:

This office is in receipt of your request for records made in accordance
with the Virginia Freedom of Information Act (VA Code 2.2-3700). You have
requested records relating to:

- A copy of any data release consent forms parents or students are asked
to sign
- Any current policy documents or guidelines governing student data usage
- Any amendments made to those forms from 2015-2019
- Documents outlining any third-party programs or applications
collecting student data

Please be advised, these records are exempt from disclosure under:

Va Code 2.2-3704 - Public records to be open to inspection; procedure for
requesting records and responding to request; charges; transfer of records
for storage, etc.

A. Except as otherwise specifically provided by law, all public records
shall be open to citizens of the Commonwealth, representatives of
newspapers and magazines with circulation in the Commonwealth, and
representatives of radio and television stations broadcasting in or into
the Commonwealth during the regular office hours of the custodian of such
records. Access to such records shall be provided by the custodian in
accordance with this chapter by inspection or by providing copies of the
requested records, at the option of the requester. The custodian may
require the requester to provide his name and legal address. The custodian
of such records shall take all necessary precautions for their preservation
and safekeeping.

The address you provided in your FOIA request is not in the Commonwealth of
Virginia and therefore the records will not be released.
