From: George LeVines

To Whom It May Concern:

Pursuant to the Massachusetts Public Records Law, M.G.L. c.66, §10, I hereby request the following records:

Any records that are "Use of Force Reports/Package" as referenced in the Massachusetts Statewide Records Retention Schedule page 192 item 13 under the section J7 "Corrections/Inmate" from January 1, 2008 to the date that this request is processed.

http://www.sec.state.ma.us/arc/arcpdf/0211.pdf

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

Sincerely,

George LeVines

Cara,

The portion of the law that you cited is in order to protect inmate privacy, no? I can understand redacting revealing information about inmates but rejecting this request in full seems a bit broad.

Please reconsider.

Thank you,

George

EDITOR'S NOTE: Phone conversation with Cara Savelli 4,000+ reports exist. Cost estimate in the hundred thousands. Savelli agreed to ask legal team if one redacted report could be provided as an example to better hone request. Also agreed to look into segregating data to see force report counts by security level and facility location.

From: Savelli, Cara (DOC)

Mr. LeVines,
Cost estimate we just discussed is attached. Working on the follow-up
details (example of a redacted Use of Force package and info in the
aggregate for Uses of Force by facility and security level) and will get
back to you ASAP on that info....Cara

From: Savelli, Cara (DOC)

Mr. LeVines,

As we just discussed, the cost to provide one example of a redacted Use
of Force packet is $100. Should you choose to pursue a copy, please make
the check payable to the Commonwealth of Massachusetts. It can be mailed
to my attention at: The Dept. of Correction, 50 Maple Street, Suite 3,
Milford, MA 01757. I am working on the cost to provide the aggregate
numbers of Uses of Force, by facility, from January 2008 to present. Let
me know what you want to do about the redacted packet....Cara

The portion of the law that you cited is in order to protect inmate
privacy, no? I can understand redacting revealing information about
inmates but rejecting this request in full seems a bit broad.

Please reconsider.

Thank you,
