Pursuant to the Massachusetts Public Records Law, I hereby request the following records:

Any record involved in or pertaining to, the unsolved murder investigation of Christine Hurlburt. Not limited to, but including: investigation reports, suspect lists, interrogations, case notes, as well as any progress the case has made in recent years with possible DNA testing. Christine Hurlburt went missing October 6 1968 and was found dead October 12 1968 In Holyoke Massachusetts.

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

The Department of State Police ("Department") has received and reviewed your request seeking the following records:

The Department considers your request as a submission pursuant to G.L. c. 66, §10, the Massachusetts Public Records Law.

Please be advised, based on information provided to this office, this incident is the subject of an ongoing investigation and the Department's reports are not yet complete. Accordingly, the report(s) you seek are not subject to public disclosure at this time pursuant to G.L. c. 4, §7, cl. 26 (f). The Supervisor of Public Records has clearly stated that disclosure of investigatory materials related to an ongoing investigation prior to its conclusion could harm ongoing investigation efforts by the Department. See Opinion No.: SPR15/203 (upholding the Department's withholding of records related to an ongoing investigation).

If you wish to challenge any aspect of this response, you may appeal to the Supervisor of Public Records following the procedure set forth in 950 C.M.R. 32.08, a copy of which is available at http://www.mass.gov/courts/case-legal-res/law-lib/laws-by-source/cmr/. You may also file a civil action in accordance with M.G.L. c. 66, § 10A.. Thank you for your attention in this matter.
