From: Beryl Lipton

To Whom It May Concern:

Pursuant to the Massachusetts Public Records Law, M.G.L. c.66, §10, I hereby request the following records:

All video of sharks captured by this department from May 1, 2017 through July 15, 2017.

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

Sincerely,

Beryl Lipton

Dear Beryl Lipton,

This email is in response to the following public records request made to the Department of Fish and Game's ("DFG") Division of Fisheries and Wildlife ("DFW"). Because DFW does not have records responsive to your request, it was forwarded to DFG's Division of Marine Fisheries ("DMF"). Your request is below:

This is a follow up to a previous request:

To Whom It May Concern:

I wanted to follow up on the following Freedom of Information request, copied below, and originally submitted on July 24, 2017. Please let me know when I can expect to receive a response, or if further clarification is needed.

Thanks for your help, and let me know if further clarification is needed.

Please be advised that DMF has video records that are responsive to your request. Because the video is quite large, DMF will have to purchase an external hard-drive on which it will copy the records. DMF estimates that the cost of the external hard-drive will be approximately $100. Please confirm that you will agree to cover the cost of the hard-drive. No other charges will be assessed to fulfill this request. Once DMF receives your confirmation, it would be in a position to provide the hard-drive to you within thirty days.

I look forward to hearing from you shortly.

Hi there,

Could you please confirm that the estimated cost for this material will be $100? Alternatively, are there other options by which I might be able to provide you with a hard drive or CDs?

Thanks so much for your help.

Best wishes,
Beryl

Hello Jared,

Thank you so much for your message. I really appreciate your willingness to discuss other ways of transmitting this information. We recently implemented an upload option via dropbox that should allow you to directly upload materials in response to a request, but the link is a bit inconspicuous; it lives at the bottom of the chain included with emails sent from MuckRock requests. However, I believe that there are limits on the amount that can be uploaded at one time if the operating system in use is an older version Internet Explorer. Do you think this might be an option that would work for your office? Otherwise, I think there is another dropbox option we could use.

Thanks so much! I hope the evening is lovely!

Best,
Beryl

Beryl,

I'll see what I can do with the link. The videos are currently on a hard drive in the possession of someone on our legal team that is not in the office today. I will check in with them on Monday. Our system is remarkably slow, so my thinking is that I will begin to upload video files at the end of the day when less bandwidth is being used. Depending on upload speed and limits, it may take several days for me to upload all the videos. I will keep you appraised of this process.

Enjoy the weekend,

Jared
