We received your request on August 2, 2018 for "All policies related to the protection of the University of Massachusetts's undocumented students and relationship with Immigration and Customs Enforcement (ICE)."

The university does not have a formal policy or policies, however university leadership has certainly established a strong position on these issues. "UMass will adhere to all applicable laws and university policies and guidelines, including the Family Educational Rights and Privacy Act (FERPA), which applies to all students, regardless of immigration status. We reaffirm that we will not release information from student education records to outside parties without permission from the student, a judicial warrant or a subpoena, or as otherwise compelled by law. Our campus police departments will not voluntarily partner with law enforcement agencies to enforce non-criminal, non-terrorism related immigration actions"

Regarding your request for "All emails to, from, and copied to the respective President and Provost of each University of Massachusetts affiliate relevant to and/or including the following words/phrases [summarized below]," collecting these documents will require a query and accounting of documents from the five UMass campuses before I can provide a good faith estimate to produce the records. I would like to request an extension. I will call the number you provided to discuss.

Under Chapter 66 of the General Laws, you have the right to appeal our disposition of your request to the Supervisor of Public Records, Office of the Secretary of State, pre@sec.state.ma.us and the right to seek judicial review of an unfavorable decision by commencing a civil action in the superior court under subsection (c) of section 10A.

I am in the process of compiling an estimate of the number of responsive e-mails from the five campuses so that the university can determine a good faith fee estimate (if applicable) for producing the records. Due to the complexity of the queries, that may take a few days.
