Pursuant to the Massachusetts Public Records Law, I hereby request the following records:
A copy of all files, including communications, reports and memos, related to the white nationalist groups "Oathkeepers" and "The Three Percenters/The 3%ers."
I request that I be properly classified as a news media requester. I am an intern for MuckRock, and I am requesting this information in that editorial capacity. MuckRock is widely known for its investigative work as well as historical pieces based on public records requests.
I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.
I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

Liam,
Good afternoon. The email search with specified keywords, after deduplication, produced 33 results. That does not include other documents/reports containing those keywords. A rough cost estimate for review/redaction of the records should be less than $100, assuming the remainder of the search does not produce a large volume of documents. Generally the majority of documents produced in response to a records request are emails but this is not immune from exception. Would you like me to proceed and provide you with an official written cost estimate or would you prefer to try and narrow your search in some way?

Hi Jason,
I am willing to narrow my search parameters by adjusting the timeframe for my request to 2015-2019. Please let me know what the new cost estimate is based on this adjustment. I am curious, however, as to why the cost of reproducing only 33 documents is almost $100 -- can you just email me the files?

Yes you would receive everything via email. The cost is not associated with sending the documents. The cost is for the time it takes to go through the review and redaction of all the records. There are various exemptions that apply to law enforcement and other public records. So there is a process that has to be completed prior to releasing any records. And just to be clear, 33 "emails" does not necessarily mean 33 "pages."
I will re-order the search with the new date parameter of 2015-2019 and let you know the results as soon as I receive them.

The new parameters reduced the count from 33 emails to 31 emails. So the final cost estimate for this particular request will not change very much at all. Let me know if you wish to further refine your request or if I should proceed with an official cost estimate.

Hi Jason,
I would like to request a fee waiver for this request, considering the records are in the public interest, as there is a public benefit to knowing about the activities of white supremacist groups in the state as well as state law enforcement's activities concerning these groups. As a member of the media, I do not plan on using the documents for commercial purposes.

Unfortunately we cannot grant a fee waiver at this time. A large number of our public records request are made by media members. These requests take a tremendous amount of time and resources to fulfill. If you would like I can provide you with an official cost estimate and you can appeal to the supervisor of records at the secretary of state's office. Please let me know how you wish to proceed.

That won't be a problem. Also, my $100 estimate is unofficial. There's a official calculation we use once we have the final number of documents. The calculation include a certain amount of free time that we are required to dedicate to every request. So it may be more or less once the numbers are in.

The internal database search only produced an additional 13 documents. Therefore there are a total of 44 documents that need to be reviewed and redacted. Using our calculation method, the timeframe anticipated to review that number of documents is within the statutorily defined "waiver" period. Therefore there will be no fee associated with your request at this time. However, please understand that your request is within a lengthy queue of requests that also require a review and redaction process. Some containing several hundred documents. At this time I do not have a time estimate for fulfilling your request but I will keep you posted with my progress.
