Pursuant to the Massachusetts Public Records Law, M.G.L. c.66, §10, I hereby request the following records:
All orders of suspension/temporary suspension of medical licenses issued by the Board of Registration in Medicine between January 1, 2010 and the present
I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.
I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 calendar days, as the statute requires.

Therefore, the board's records are records of the EOHHS. It should not be necessary for me to resubmit my request. Please fulfill it, as is your duty under the public records law.

The Executive Office of Health and Human Services (EOHHS) is not the custodian of the records you requested. The Board of Registration in Medicine (BORIM) is a constituent agency of EOHHS, and none of their records are within our Office. Each constituent agency of EOHHS has separate legal and public records staff to handle requests. We kindly direct you to file your request with their office.

Supervisor of Records,
I sent a public records request to the Executive Office of Health and Human Services (EOHHS) for records kept by the Board of Registration in Medicine (BORIM). BORIM is a division of EOHHS, not a separate agency. EOHSS asserts that it is not obligated to fulfill my records request because BORIM's records are not kept in the main EOHHS office. EOHHS has advised me to resubmit my request directly to BORIM.
This is inappropriate. EOHHS is obligated to fulfill all records request submitted to it, regardless of the physical location of its records or which department keep the records. By telling me to resubmit my request rather than simply forwarding it to the appropriate person, EOHHS is creating unnecessary delays.
I ask that you order EOHHS to provide me with the records I requested and provide EOHHS with training on its obligations under the Public Records Law.
