From: George LeVines

To Whom It May Concern:

Pursuant to the Massachusetts Public Records Law, M.G.L. c.66, §10, I hereby request the following records:

All maritime damage claims (item number 5 under subhead N13 Maritime Administration in the state records retention manual pp. 268, available here: http://www.sec.state.ma.us/arc/arcpdf/0211.pdf) from one year prior to the date that this request is processed.

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

Sincerely,

George LeVines

Dear Mr. LeVines,

I received your April 16th email (below), stating that you are following up to a previous request for maritime damage claims.

The Authority has already responded to your request for maritime damage claims, by way of a letter dated March 18, 2014, that was sent to you via email and first class mail. The letter advised you of the cost of proceeding with your request. You did not respond to that letter, but sent another "follow up" request on April 1st, 2014. As included in your email chain below, I responded to your email on April 1st and (again) provided you with a copy of the March 18th letter. The Authority did not receive a response to its email (or the attached letter) from you.

In response to your email today, I (again) direct your attention to the March 18th letter. For your convenience, I am (again) providing you with a copy of the letter as an attachment to this email. As stated in the letter, the Authority estimates that the cost of complying with your request is $864.70. The Authority will not proceed further with your request until it receives a check from you in that amount.

Sincerely,
Michelle Kalowski

Michelle,

My apologies for letting this request slip through the cracks.

I would like to amend my request to include only the most recent maritime damage claim.

If your office requires that I submit a new request, I completely understand.

Thanks for your patience,

George

From: Kalowski, Michelle

Please feel free to contact me if you need further information.

Sincerely,
Michelle

Michelle,

Sorry, I meant the singular most recent maritime damage claim. The claim submitted or processed most recently to the date that this communication is received.

Hope that clears it up,

George
