To Whom It May Concern:

Pursuant to the Massachusetts Public Records Law, I hereby request the following records:

All communications including emails and written between the Institute for Clinical and Economic Review and the Massachusetts Health Policy Commission for 2017 and 2018.

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

Sincerely,

Mr. Kane,

I am writing in response to your request for public records, below. Attached please find a zip file with emails and attachments between the Institute for Clinical and Economic Review (ICER) and the Massachusetts Health Policy Commission (HPC) for 2017 and 2018. We are providing these records in electronic message format, and we have granted your request for a waiver of fees. Where applicable, we have included "email threads" rather than each individual email communication. Please reply to let me know you received this response and attachments.

Please note that four (4) attachments have been redacted to suppress small cell values of data (designated by *). These small cell values of data from the Center for Health Information and Analysis (CHIA) All Payer Claims Data (APCD) are exempt from release under M.G.L. c.4, sec. 7(26)(a), M.G.L. c.12C, and 957 CMR 5.11(3). The redacted versions of these attachments are designated "suppressed" in the materials we are releasing to you:
* Icer_suppressed.xlsx
* HPC-HCRU_results_2107060_suppressed.xlsx
* Icer3_suppressed.xlsx
* Icer4_clean_suppressed.xlsx

In an effort to respond to your request for communications specifically between the HPC and ICER, we have not included numerous emails from the ICER general mailing list or ICER Weekly View mailing list received by the HPC: https://icer-review.org/about/contact/ If you would like us to provide ICER mailing list emails, please let us know.

As a requestor of public records, you have the right of administrative appeal to the Supervisor of Records under 950 CMR 32.08(1) and the right to seek judicial review of an unfavorable decision by commencing a civil action in the superior court.

Best,
Lisa
