Pursuant to the Massachusetts Public Records Law, I hereby request the following records:

Please provide the construction phasing plans for all throat options under consideration as identified of the I-90 Allston Multimodal project's Scoping Summary Report dated August 7, 2020, including the Modified At-Grade option, the SFR Hybrid option, the Modified Highway Viaduct option and the no build alternative which were used to determine the impact the project would have on Worcester Line two-track service during construction and the impact the construction process will have on turnpike capacity.

In addition, please provide documentation on whatever analysis has been done to maintain 6 lanes of turnpike capacity and 2 tracks of Worcester Branch capacity at all times throughout the construction period of each alternative.

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

Dear Ms. Connaughton,
Please find attached plans that have already been made public which contain information related to construction. However, please be advised that we are withholding records that depict construction staging sequencing under Massachusetts General Laws Chapter 4, Section 7(26)(d), relating to policy positions being developed by MassDOT; this exemption is intended to avoid the premature release of materials that could taint an ongoing deliberative process.

Releasing records that depict staging sequencing, or durations of time for each construction stage, will put MassDOT at a disadvantage in any future competitive bidding process for the work. Withholding this information is necessary at this time to ensure that an open, fair bidding process takes place and that our project delivery method is not impaired. Disclosure would negatively affect MassDOT’s ability to develop its policy positions during this ongoing deliberation, particularly as it relates to developing and evaluating how we will package and bid this work going forward, and the determination of the agency’s project delivery method. Therefore, these records are exempt from disclosure under Exemption (d) at this time.

In addition, MassDOT is withholding these records under Exemption (d) because they are part of our deliberations concerning the identification of a preferred alternative. Releasing these records would negatively affect MassDOT’s ability to develop its policy positions during this ongoing deliberation, particularly as it relates to evaluating the various options and selecting a preferred alternative within the context of the environmental review process. Such construction staging plans are preliminary and illustrative in nature, and will not be binding on the selected contractor, which will develop its own final construction staging sequence. Further, the construction stage sequencing and durations of time for each stage are dependent upon multiple factors that remain under consideration and are subject to change, to reflect among other factors the evolving design of the different project alternatives. For all these reasons, they are not considered “reasonably completed factual” information within the meaning of Exemption (d). Therefore, the withheld records are exempt from disclosure under Exemption (d) at this time.

Please be advised that you may appeal this response to the Supervisor of Records, pursuant to 950 CMR 32.08(1) (the Code of Massachusetts Regulations), and have the right to seek judicial review by commencing an action in the Superior Court under G. L. c. 66, § 10A(c).
