Mr. Michael Morisy,

Hi Michael,

I have received your March 9, 2011, FOIA requests dealing with implications of federal reform on Massachusetts and tiered covered offerings in the Commonwealth Choice program.

Regarding the former, all of the information we currently have can be viewed here. This page will be updated as more information becomes available.

I have circulated your second request among staff here at the Health Connector and will get back to you as soon as I have something to report.

Mr. Morisy,

This letter constitutes a preliminary response to your public records request of April 27, 2011 , below. EOHHS is currently in the process of identifying any records that meet the description contained in your request and that are subject to disclosure.

EOHHS normally charges the following fees for copies of public records:
--$.20 per page for photocopies;
--$.50 per page for computer printouts;
--$50.00 per hour for the creation of electronic reports; and
--A pro-rated fee for performing a search for requested records or segregating exempt information from non-exempt information which is contained in a requested record. This fee is based on the hourly rate of the lowest-paid employee capable of performing the task.

To Whom It May Concern:

I am appealing a denial of access to public records. On Jun 8, 2011, I filed a request for:
All documents, including power points, that discuss the financial implications in both the public and private sector of the Affordable Care Act on Massachusetts. Including all documents that estimate the impact on those currently enrolled in an insurance plan offered through the Connector.

I filed this request with the Executive Office of Health and Human Services of Massachusetts. My request is now past due by almost three months, and I believe this constitutes an improper denial of access to public records.

I have enclosed the communications between myself and the Connector Authority of Massachusetts.

Sincerely,

Michael Morisy

Hi Michael,

Just to clarify, are you looking to have the attached document updated to reflect current July, 2011 numbers?

Regarding your previous request for policy proposals, I wrote to you on March 23:

"Regarding your request for documents detailing cost estimates and policy proposals, we need to ask for more specific direction. (Please see 950 CMR 32.05 (4): "Any person seeking access to a public record or any portion thereof shall provide a reasonable description of the requested record to the custodian so that he or she can identify and locate it promptly.")

I will follow up on your request for the enrollment projection documents.

Thanks,
