To Whom It May Concern:

Pursuant to the Massachusetts Public Records Law, M.G.L. c.66, §10, I hereby request the following records:

A request on for the entertainment license that allowed Dispatch to play their enormous "final" show at the Hatch Shell on 7/21/04. It was the largest event ever held there (I think).

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 calendar days, as the statute requires.

Sincerely,

Perry Eaton

Dear Mr. Eaton;

The City of Boston's Office of Consumer Affairs and Licensing, does not
license entertainment at the Hatch Shell. It is state property. I
therefore believe the Department of Conservation and Recreation (a state
office) has jurisdiction over that property.

Thank you,

From: Bilbo-Miles, Alice (DCR)

Dear Mr. Eaton,

This office is in the process of identifying and consolidating records that may be responsive to your request, and will contact you shortly. At that time, the office will inform you of whether it will be withholding any documents as exempt or privileged material. In addition, the response may contain a statement of costs associated with complying with your request, pursuant to the Public Records Law, section 7(26) of Chapter 4 and section 10 of Chapter 66 of the General Laws of Massachusetts. If, however, the cost of responding to your request may exceed ten dollars, including the cost of copies at twenty cents per page, the office will notify you of the estimated cost and will request payment prior to proceeding further in accordance with 950 CMR 32.06(2).

Finally, please note that this search does not cover records that may be in the custody of any other department or office subject to the Public Records Law, as a request to inspect or copy any such records must be made directly to that department or office.

Sincerely,

Alice Bilbo-Miles

Dear Mr. Eaton,

This is in response to your email dated August 4, 2014 relating “the entertainment license that allowed Dispatch to play their enormous “final” show at the Hatch Shell on 7/21/04” and to follow up on August 6, 2014 response.

A diligent search of our files has not revealed a responsive record. However, it should be note that Massachusetts Statewide Retention Schedule, which applies to all records of state government, set forth the retention period for “Special Events Records” as “until administrative use ceases”. Whereas the records you seek are 10 years old it’s very likely that this disposal schedule would account for the search result.

Thank you for your patience.

Sincerely,

Alice Bilbo-Miles
