Pursuant to the Massachusetts Public Records Law, M.G.L. c.66, §10, I hereby request the following records:

All documents uploaded by Eagleton School, Inc. during the school's 2013 program review report.

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Dear Mr. Feathers

I write in response to your public record request, dated Monday, December 9, 2013, related to Eagleton School, Inc. and your request, dated Friday, December 13, 2013, related to private school licenses. The Massachusetts Department of Elementary and Secondary Education (the “Department”) intends to respond to these requests as quickly as possible, and free of charge. We do, however, have questions.

First, with respect to Eagleton School, Inc., the Department’s records do not neatly align with your record request because the Department’s site review process, though ultimately evaluative, takes place in collaboration with the school. During the course of a site review process, the Department receives records from the school before, during, and after actually visiting the school, issuing the site review report (which takes place after the school visit), and working on corrective action. We can provide to you all records that Eagleton submitted to the Department throughout the site review process, but please let us know if you are looking for anything specific.

Second, with respect to “private schools that have lost licenses,” the Department assumes you mean “approved private special education school programs” that have received the Department’s authorization to receive public funding to provide special education services to certain students with IEPs. As to these “approved private special education school programs,” the Department has never pulled or revoked its authorization to receive public funding to provide special education services. The Department has placed programs on probation after which, of their own initiative, programs have closed. All instances in which the Department has placed approved private special education school programs on probation can be located on the Department’s website<http://www.doe.mass.edu/pqa/default.html?section=archive>.

Though we’re happy to provide records in whatever format you prefer, this presents challenges in cases where records need to be redacted. Some of the records related to Eagleton, for example, contain personally identifying information about students that must be redacted. If you have additional thoughts on this, please let me know. Otherwise, wherever possible, we’ll provide records formatted in Microsoft Word, and we’ll format those documents that require redaction in .pdf format.
