Pursuant to the Massachusetts Public Records Law, M.G.L. c.66, §10, I hereby request the following records:
Any documents related to the all-electronic tolling structures on the Massachusetts Turnpike, including their function prior to being used for tolling purposes.
I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.
I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 calendar days, as the statute requires.

I think the clarification needed though needs to be more in keeping with …..current toll structure documents……future “toll” structure documents like for All Electronic Tolling…..also do you want contracts for every aspect of tolls and if so….going back months/years?

I am requesting any contracts for software (currently or in the future) used by the tolling structures that will become All Electronic Tolling, in addition to a copy of any database(s), such as license plate scans, currently used by the Electronic Tolling Structures. To be clear, I am seeking documents specifically related to the tolling structures recently placed on I-90 which will soon become All Electronic Tolling. The time frame would be between 2012 and the date this request is processed.

“MassDOT is in the process of making a recommendation to the Records Conservation Board (RCB) regarding retention schedules related to All Electronic Tolling records. Until RCB approval of the length of time to store the data is received, MassDOT will continue to collect and retain speed data. Once the RCB provides guidance, MassDOT will act accordingly and purge the MassDOT system of all data that no longer needs to be retained. MassDOT has made this decision out of an abundance of caution to ensure MassDOT is within whatever amendments may be made by the RCB.”
On background:
The Records Conservation Board, organized by MGL c 30, § 42, is composed of the Supervisor of Public Records, the State Archivist, the Attorney General, the Comptroller, the Commissioner of Administration and Finance, and the State Librarian. No state agency records may be destroyed or transferred without the approval of the Board.
The functions of the Board are:
· To approve or amend the Statewide Records Retention Schedule, which describe the lifespan of the state government record.
· To approve Transfer and Destruction Permissions which authorize the agency to implement the provisions of the Statewide Records Retention Schedule on a specific increment of records
· To set standards for the management of state records.
The Board meets the first Wednesday of every month at the State Library on the third floor of the State House.

What are the Hot List categories used by the AETS? How many license plates are currently on the Hot List?
Who is authorized to view toll zone transactions in real time, other than MassDOT employees?
Does MassDOT plan to incorporate automatic vehicle occupancy detection when Raytheon develops it?

Please note that MassDOT has not utilized the All Electronic Tolling Hot List or created any Hot List categories. Real-time viewership of tolling transactions is limited to MassDOT employees, and contractors for quality-assurance and maintenance purposes. MassDOT has not had active discussions regarding current or future automated vehicle occupancy detection technology and potential changes to the tolling system will be vetted with a thorough public process.
