Pursuant to the state Freedom of Information Act, G.L.M. c.4, €7, clause 26th, I hereby request the following records:

All policy documents, specifically including any external or internal analysis and studies, concerning a comparison of the current structure of Medicaid to an all-managed care structure.

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

This letter constitutes a preliminary response to your public records request of January 15, 2011, seeking documents concerning a comparison of the current Medicaid structure to an all-managed care structure. MassHealth is currently in the process of identifying any records that meet the description contained in your request and that are subject to disclosure.

MassHealth normally charges the following fees for copies of public records:

--$.20 per page for photocopies;
--$.50 per page for computer printouts;
--$50.00 per hour for the creation of electronic reports; and
--A pro-rated fee for performing a search for requested records or segregating exempt information from non-exempt information which is contained in a requested record. This fee is based on the hourly rate of the lowest-paid employee capable of performing the task.

You will be notified of the fee for producing any relevant records that have been identified, and upon receiving payment in the amount of the fee, the records will be made available to you. Alternately, such fees may be waived.

I am appealing a denial of access to public records. On January 26, 2011, I filed a request for:
All policy documents, specifically including any external or internal analysis and studies, concerning a comparison of the current structure of Medicaid to an all-managed care structure.
I filed this request with the MassHealth Privacy Office. My request was denied on March 16, 2011, but I believe this was an improper denial.
Some materials comparing Medicaid structure with an all-MCO model are findings of fact and are not, in practice, “inter-agency or intra-agency memoranda or letters relating to policy positions being developed by the agency.” We asked that the request be reconsidered and non-exempt materials be released, with redacted information being noted.
