From: George LeVines

To Whom It May Concern:

Pursuant to the Massachusetts Public Records Law, M.G.L. c.66, §10, I hereby request the following records:

Records, databases, reports and any documents of any animal seizures — living or deceased — by the department dating back five (5) years from the date this request is processed in the towns of Lynn, Swampscott, Marblehead, Salem, Danvers, Beverly, Peabody, Ipswich, Essex, Manchester (by the Sea), Gloucester, Rockport, Newbury and Rowley.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. I am a member of the media reporting at the Salem News. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 calendar days, as the statute requires.

Sincerely,

George LeVines

Dear Mr. Musgrave:

Dear Mr. LeVines,

The Department of Conservation and Recreation (DCR) legal department has been requested by the Office of Law Enforcement (OLE) under the Executive Office of Energy and Environmental Affairs (EOEEA), commonly known as the Massachusetts Environmental Police (MEP), to respond to your request for a copy of certain public records, as described in your email dated August 27, 2014 relating to "animal seizures - living or deceased - by the department dating back five (5) years " in the towns of "Lynn, Swampscott, Marblehead, Salem, Danvers, Beverly, Peabody, Ipswich, Essex, Manchester (by the Sea), Gloucester, Rockport, Newbury and Rowley."

This office is in the process of identifying and consolidating records that may be responsive to your request, and will contact you shortly. At that time, the office will inform you of whether it will be withholding any documents as exempt or privileged material. In addition, the response may contain a statement of costs associated with complying with your request, pursuant to the Public Records Law, section 7(26) of Chapter 4 and section 10 of Chapter 66 of the General Laws of Massachusetts. If, however, the cost of responding to your request may exceed ten dollars, including the cost of copies at twenty cents per page, the office will notify you of the estimated cost and will request payment prior to proceeding further in accordance with 950 CMR 32.06(2).

Finally, please note that this search does not cover records that may be in the custody of any other department or office subject to the Public Records Law, as a request to inspect or copy any such records must be made directly to that department or office.

Thank you for your cooperation.

Very truly yours,

Alice Bilbo-Miles
Paralegal
Department of Conservation and Recreation
