To Whom It May Concern:

Pursuant to the Massachusetts Public Records Law, I hereby request the following records:

Video footage from the Massachusetts State Police Air Wing units that were over Boston during the protests on May 31st 2020 into the morning of June 1st 2020.

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

Sincerely,

Ethan Hansen

Supervisor of Public Records,

I submitted a public records request to the Massachusetts State Police more than 10 business days ago on 4/26/21, but I have not received a response. Massachusetts G. L. c. 66, ยง 10(a-b); 950 CMR 32.06(2)(a) specifically requires that an agency provide a response to a public records request within ten business days of receipt of that request. Please follow up with this agency about my request. Pasted below is the full text of the request submitted to the Massachusetts State Police.

Please find a copy of the request attached and it can also be seen at https://www.muckrock.com/foi/massachusetts-1/air-wing-footage-from-may-31st-and-june-1st-2020-boston-protests-111270

Thank you!

Good afternoon,

I wanted to follow up on next steps for my appeal SPR21/1216 as the Department Of State Police has continued to be non-responsive to this request. I understand that my only remaining action may be to initiate civil action but wanted to follow up with the Public Records Division.

Thanks,
Ethan Hansen

Good Morning,

The Department of State Police has located records responsive to your public records request. The records are too large to e-mail, do you have a mailing address that the Department can send the records?

Hi Dan,

Thanks for the update, it looks like it may have gotten lost in the mail. Also possible that if it wasn't sent via USPS the carrier didn't deliver it due to address issues.

If you are not sending it via USPS please use the following address:
Ethan Hansen
23 Essex St #760770
Melrose, MA, 02176

If you are using USPS the address is:
Ethan Hansen
PO Box 760770
Melrose, MA 02176

I can also pick it up at the Medford barracks if that's easier.

Good evening,

I received five DVDs labeled Air 3 003A/B, 004A/B and 005A. Is this the extent of the responsive materials or are there still some remaining?
