On August 12, 2010, the AAB granted petitioner Donald Warner, on behalf of the City of Somerville, to remove a vertical wheelchair lift on the condition that compliance would be achieved at existing entry and HP/parking area at the Union Square Plaza Building, 66-70 Union Square, Somerville, MA per 521 CMR §§§§20, 23, 25, 26. Written confirmation and photographic evidence of compliance was to have been submitted to the Board prior to the vertical wheelchair lift removal.

Pursuant to the state Freedom of Information Act, G.L.M. c.66, §10, the following records are requested:

Please provide electronic copies of all written and photographic confirmation received by MAAB following said decision, proving that compliance of above-named regulations has been achieved following the 8/12/10 decision on AAB Docket # V98-159 re: 66-70 Union Square Plaza Building, Somerville, MA 02143.

We also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is not to be used for commercial purposes.

In the event that fees cannot be waived, we would be grateful if you would inform us, via Muckrock, of the total charges in advance of fulfilling this request. We require that the request be filled via accessible format (machine-readable) as possible; and via e-mail attachment if possible.

Greetings,

The Department of Public Safety ("Department") received your public records request dated May 23, 2012, and it has been referred to me for response. You requested documents regarding "AAB Docket # V98-159 re: 66-70 Union Square Plaza Building, Somerville, MA 0214."
I write to provide you with the status of your request and an estimate of the cost of producing these documents. A custodian may charge for the time it takes to search for and segregate documents responsive to a public records request. See 950 CMR 32.06(1)(c). The regulations provide that the custodian must charge the hourly rate of the lowest paid employee capable of performing the task. See Id. The rate costs associated with this request will be $20 an hour. The estimated total search and segregation time is .5 hour. Therefore, the cost of searching for and segregating these documents is $10.

If you wish for a copy of these documents, please send a check for $10.00 payable to the "Commonwealth of Massachusetts" to my attention. Upon receipt of payment, this office will begin to process your request.
