To Whom It May Concern:

Pursuant to Maryland's Public Information Act ("PIA"), I hereby request the following records:

All policies, procedures, memorandums of agreements, other memos, directives, communications, occurrence reports, and any other relevant materials regarding the reporting, negotiations, control, aftermath, and general treatment of hostages taken or individuals restrained in a hostage-like manner by individuals detained or under the supervision of facilities maintained under the jurisdiction of this agency, including juvenile, local, and private facilities, if applicable. If additional policies are maintained by other agencies, direction indicating such would be greatly appreciated.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 30 business days, as the statute requires.

The Department of Public Safety and Correctional Services (DPSCS) has
received your request for information under the Maryland Public Information
Act (PIA), Maryland Annotated Code, General Provisions Article(GPA),
§§4-101 through 4-601. In your letter, you requested the following:

*All policies, procedures, memorandums of agreements, other memos,
directives, communications, occurrence reports, and any other relevant
materials regarding the reporting, negotiations, control, aftermath, and
general treatment of hostages taken or individuals restrained in a
hostage-like manner by individuals detained or under the supervision of
facilities maintained under the jurisdiction of this agency, including
juvenile, local, and private facilities, if applicable. If additional
policies are maintained by other agencies, direction indicating such would
be greatly appreciated.*

This request is being denied under Maryland General Provisions Article §
4-351( Records of investigation, intelligence information, security
procedures, or investigatory files). The Article states that the custodian
may deny the request for *records that contain intelligence information or
security procedures of the Attorney General, a State’s Attorney, a
municipal or county attorney, a police department, a State or local
correctional facility, or a sheriff.*

Pursuant to GP § 4-203(c)(1)(i)(4), I am required to inform you of the
remedies available for review. You may seek resolution of a dispute under
GP § 4-1B-04. You may also seek judicial review under GP § 4-362.

Pursuant to GP § 4-1A-05, if you dispute the reasonableness of the fees for
searching for, preparing, or reproducing these records, you may file a
complaint with the State PIA Compliance Board.
