Request for 2021 Agency Rosters & Salary Data

Amelia McDonell-Parry filed this request with the Fort Detrick Police of Maryland.

It is a clone of this request.

From: Amelia McDonell-Parry

To Whom It May Concern:

Pursuant to the Maryland Public Information Act, I hereby request the following records for every sworn officer and civilian member of the Fort Detrick Police for fiscal years 2020 and 2021:

1. First and last name;
2. Unique sequence number;
3. Current badge number
4. Any previously recorded badge number that was used before the current one;
5. Race;
6. Gender;
7. Hire date;
8. Current salary;
9. Overtime paid per fiscal year.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. Alternatively, please consider waiving any fees, pursuant to ยง 4-206(e)(2)(ii) of the General Provisions Article, as this request is on behalf of individuals served by the Maryland Office of the Public Defender, a state government agency, which solely serves indigent citizens of Maryland. As a result, my request for the above-listed public records is in the public interest. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 calendar days, as the statute requires.

From: Fort Detrick Police

This request is the same request that was received on 5 November 2021. On 15 November 2021, Mr. Maleson responded with the following:

Ms. Levi -
I am an attorney at Fort Detrick, assisting with response to your MPIA request. I typically advise Fort Detrick and USA Medical Research and Development Command on response to FOIA requests. I am not very familiar with Maryland Public Information Act requests, but my brief research of MPIA suggests that it only applies to State agencies (v. FOIA, which applies to Federal agencies). Fort Detrick is a Federal entity. Please let me know if I have missed something here.

Thank you,

Stephen Maleson

This request under Maryland Public Information Act (MPIA) is not appropriate, because that is a state statute for state agencies, and we (Fort Detrick) are a Federal agency, subject to FOIA.
