Dear Nina Hawkins:

Pursuant to the Maryland Public Information Act (found in Maryland’s State Government Article, an article within the Maryland Annotated Code, §§10-611 to 10-628), I hereby request the following records:

I wish to expect documents concerning the Pretrial Risk Assessment Tool used by the Division of Pretrial Detention, County of Harford. Harford was listed as using a Pretrial Risk Assessment similar to that of Baltimore County. If Harford is not indeed using this tool, this request pertains to whatever tool the county is using as a pretrial risk assessment, if any.

This request is for:

1. A copy of the risk assessment tool worksheet used by the Division of Pretrial Detention for Harford. Specifically, which questions are asked in the risk assessment and the weight the answer to each of these questions is given in calculating a risk assessment score.

2. A copy of any validation studies conducted on the risk assessment tool used in Harford, where a “validation study” means an evaluation of the tool’s accuracy in predicting what the tool is designed to predict. If no validation studies have occurred, we request a copy of any records pertaining to inquiries for the need of validation studies, or discussion of potential or actual validation studies.

3. A copy of any privacy impact assessments, use policies, standard operating procedures, data retention policies, legal opinions, warranties, non-disclosure agreements, contracts, liability waivers, insurance agreements, Requests for Proposals, Responses to Requests for Proposal, Memorandums of Understanding, Letters of Interest, usage policies, or informal agreements pertaining to Harford’s use of pretrial risk assessment tools.

4. For each defendant evaluated by the risk assessment tool, we request the completed worksheet, the risk score and the judicial recommendation (bail, released on recognizance or other) for the past three years. We request this information in an aggregated electronic format (spreadsheet or database), if this is its native format. If the worksheets or information contain material explicitly exempted from disclosure under the Public Information Act, we request you redact it and provide the remaining material.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
