Pursuant to the state open records law, Ariz. Rev. Stat. Ann. Secs. 39-121 to 39-122 and 39-128, I hereby request the following records:
Now that Joe Arpaio has finally closed the investigation into president barack obama's birth certificate, this FOIA request seeks
any public record with regards to the investigation, this should include public investigatory records as well as financial records.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I would request your response within ten (10) business days.

Please be advised that the MCSO did not pay for local transportation (i.e., rental car, taxi, shuttle, etc.) as this was pre-arranged at no cost by the deputy, Brian Mackiewicz.
Deputy Mackiewicz has been on extended leave and has been unavailable to contact regarding this request for records. It is unknown if he is in possession of any records which may be responsive to this request.
Also, after a thorough search of MCSO records was conducted, no other documentation regarding the investigation into President Barack Obama's birth certificate was found. The requester may want to contact the Maricopa County Cold Case Posse to request any records their office may maintain regarding this subject.
The fee breakdown for completed requests are as follows:
Documents: $5.00 for first 10 pages & $.50 for each additional page
CD's: $15.00 each
*Please Note: Documents are available for 30 business days from the date of this notice to be picked up and/or reviewed. After 30 business days has elapsed, the request will be closed and the documents destroyed. In order to obtain requested documents after the 30 business days, a new public records request will have to be resubmitted and reprocessed. All requests are handled in the order they are received.

This is Mark Casey, the Director of Public Information for the Maricopa County Sheriff's Office.
The records provided by our Legal Liaison are complete.
The Cold Case Posse did not share its records or activities with either the Legal Liaison office or the incoming Sheriff, who arrived January 1, 2017. Simply, you have the records we can produce, because these are the only records maintained by the Sheriff's Office.
As background, Cold Case Posse was created by the former Sheriff. It operated under his direct guidance and its activities and records were not shared in the normal course of document workflow and retention in this office. Therefore, your questions about whether these records in fact exist, are best directed toward former Sheriff Arpaio, who lives in Fountain Hills, Arizona.

I understand your assertion that the "cold case posse" which as you said was sanctioned and organized by MCSO may be in violation
of the law if they did not keep and provide records for an "investigtion", before I contact the ACLU to determine of this is an actionable
breach of the law, I would like to know if there is minimally a record available to MCSO regarding the closure of the investigation
which minimally should have generated *some* paperwork.
I will be submitting new requests today with regards to to documents on the commissioning and funding of the "cold case unit" and intend
to follow-up with a lawsuit if these records are not provided.
please consider this an APPEAL under FOIA
