Pursuant to the Maine Freedom of Access Act § 402 et seq., I hereby request the following records:

1. All incident reports or other records documenting each time your agency's S.W.A.T. team (sometimes called a police paramilitary unit) was deployed.

2. In the event such records are not kept, I request a list of the dates of deployment of the agency's S.W.A.T. team during this period.

3. In the event these records/dates are not available for the entire time period covering this request, I request you supply the above information for the period covering the present back to as long as such records/information are available.

This request is being made for academic, not commercial, purposes.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 3 business days, as the statute requires.

By way of another update:

Today I spoke about your Freedom of Access Act request with the Commanding Officer who oversees the Maine State Police Tactical Team.

While we will be unable to provide access to narrative reports of the Tactical Team's responses to individual incidents (see inter alia 16 MRSA § 804(3), (7), (8)), we will be able to provide to you a copy of a "call diary" that the Tactical Team maintains. This document lists the date, time, and a synopsis of each call the Tactical Team has received since 2004 requesting the Tactical Team's assistance.

I anticipate the call diary will be able to be provided to you sometime next week, once it has been reviewed and any confidential information that might be included in the diary has been redacted.

2. Is your agency's SWAT team strictly an assisting agency? That is, is it only deployed when other jurisdictions request assistance requiring a SWAT team?

1. The Maine State Police Tactical Team was established in 1982.

2. Our Tactical Team responds to high risk incidents that fit the criteria for a Team response, when requests are received from our own agency (the Maine State Police) and local, county, and federal agencies.
