From: Curtis Waltman

To Whom It May Concern:

Pursuant to the Maine Freedom of Access Act ("FOAA"), I hereby request the following records:

Any and all policies, procedures, directives, memorandums, and any other guiding materials regarding matters pertaining to firearm acquisition, licensure, use, and transfer, including, but not limited to, the following:
• policies and procedures on the issuance of firearms permits and licenses. (Please note that this point is not a request for the identities of individual permit or license holders, but, rather, is a request for governmental policies and parameters regarding the process and regulations by which one may obtain either a permit or a license. If separate strictures exist for each, provision of both would be greatly appreciated.)
• policies and procedures on the revocation of firearms permits and licenses.
• any and all available policies and procedures regarding local firearms policies. Please provide all such materials that alter or supplement departmental procedures.
• policies and procedures regarding the sale and purchase of firearms. Please include all materials regarding the appropriate qualifications for the sale or purchase of firearms. Please include materials for particular venues, if available, including but not limited to the sale and purchase of firearms at gun shows.
• policies and procedures regarding the transfer, either out-of-state or between individuals, of firearms.

Please include all available segregable data.

Please also provide all available data, statistics, or reports regarding matters pertaining to gun acquisition, licensure, use, and transfer, including, but not limited to, the following:
• the issuance of firearms permits and licenses.
• the revocation of firearms permits and licenses.
• incidents involving the use of a firearm.
• the sale and purchase of firearms.
• the transfer, either out-of-state or between individuals, of firearms.

If various policies or reports exist dependent on the type of firearm, provision of all applicable materials would be greatly appreciated. Should they be voluminous, provision of materials on rolling basis would be greatly appreciated.

Should your agency believe that any additional policies, procedures, reports or other analysis pertaining to firearm acquisition, licensure, use, transfer, deaths, incidents, or any related issues may reside with another agency or agencies, indication of such agencies would be greatly appreciated.
Please notify us if further clarification is necessary.

Dear Mr. Waltman:

This email concerns your recent FOAA request, copied below.

At this time I estimate that your request will be able to be processed by our agency within forty (40) business days.

Though I cannot yet provide an estimate of the total fee that will be charged by our agency to process your request, there is a reasonable possibility that the total fee to do so will exceed thirty dollars ($30).

Dear Mr. Waltman:

A point of clarification regarding your FOAA request:

Are you seeking records from a defined timeframe? For example, records responsive to your request that were received or created by our agency between 01 January 2015 and the date of your FOAA request?

I ask because the breadth of your request is otherwise quite considerable, and we want to ensure that we provide you with information you are seeking in a time- and cost-efficient manner.

Hello Mr. Parr,

Thanks so much for your help. Feel free to proceed with the request, and we'll happily agree to pay up to $30 for processing and copying fees. However, if policies or responsive materials exist online or in an electronic format that might reduce costs, we'd prefer those and would be happy to accept them. Please advise on the most cost efficient manner in which to go about this. As always, thanks so much for what you do.

Best,
Curtis Waltman

From: Parr, Christopher

Dear Mr. Waltman:

This email further responds to your FOAA request.

Given the number of records that have been forwarded to me for review in response to your request, I estimate that the cost to process the request will be somewhere in the range of $30 to $65. Again, that is just an estimate; the total fee might be more or less than that range.

Whereas you have said you are willing to pay “up to” $30, do you want to narrow or revise the scope of your request in any way?

If not, do you want us to continue to work on your request, given the above estimate?

Insofar as online resources of information that might be responsive to your request are concerned, you might wish to review the following website: http://www.maine.gov/dps/msp/licenses/weapons_permits.html

To Whom It May Concern:

At this time I have eight-two (82) records responsive to your FOAA request to send to you.

The total fee we are charging to process the request is sixty-seven dollars ($67.00), which may be paid with a check or money order made payable to, “Treasurer, State of Maine.” Please remit payment, to my attention, to the following postal address:

Maine State Police
45 Commerce Drive, Suite 1
Augusta, ME 04333-0042

I have a couple of processing-related questions for you at this time:

1. Would you like the records emailed to you or sent via postal mail? If you would like them sent by postal mail, please provide a postal mailing address, at your convenience.

2. The Maine State Police Sergeant from whom a great many of the records we are providing were ascertained began work in the Special Investigations Unit (which inter alia processes firearms-related permits) in April 2014. Would you like us to search further for what, if any, additional records there might be that that Sergeant’s predecessor might have (i.e., for records from between 01.01.2014 and, say, 04.01.2014)? If so, please let me know. (Please note that additional fees will be charged.)
