If there are any fees for searching or copying these records, please email me if the cost will exceed $50. However, I would also like to request a waiver of all fees in that the disclosure of the requested information is in the public interest and will contribute significantly to the public’s healthcare transparency, healthcare access, fairness and greater overall public awareness.
The law requires that you respond to and fulfill this request "as promptly as possible." If you expect a significant delay in responding to and fulfilling this request, please contact me by phone or via email with information about when I might expect copies or the ability to inspect the requested records.

Good afternoon Kamran Ahmed,

This will acknowledge your request for public records from the Maine Board of Dental Practice (the "Board"). The Board's good faith, non-binding estimate of the time it will take to compile your requested data is approximately two weeks. 1 M.R.S. § 408-A(3). Furthermore, the good faith, non-binding estimate of the cost is approximately $75. 1 M.R.S. § 408-A(3).

The Board can provide you with an Excel spreadsheet with the information you are requesting. We propose to charge a flat, combined fee of $75.00 for the requested search, conversion, and review of the records, as opposed to charging hourly fees for searching, reviewing, compiling, and redacting records as may be necessary and as otherwise authorized by statute. See 1 M.R.S. § 408-A(8). It is my expectation that this flat, combined fee will be easier to compute for all parties, and ultimately result in a cost savings to you.

Please note that the Board does not maintain an email record for all individuals, but will provide the information if available. To the extent the Board does not maintain this information, it is not required to create a new record, and therefore denies your request to that limited extent. 1 M.R.S. § 408-A(6).

Once you indicate your willingness to pay the $75.00 fee, we will begin the process you have requested. In addition, I ask that you please complete the attached request form and submit the method of payment in advance. The form may or may not include all of the fields you are requesting, but board staff will use the form and your email to capture the content of your request.

I am the designated contact person for the Board of Optometry ("Board") for records requests. I am writing in response to your request, received by my Board on July 9, 2021, for certain data as to certain health care providers including optometrists.

Your request is governed by Maine's Freedom of Access Act ("FOAA"), 1 M.R.S. §§ 400-414. Therefore, please be advised that if certain documents or information that you requested are confidential or otherwise not subject to disclosure under FOAA, or do not exist in the form of records, they will not be provided. Accordingly, I object to the production of records not subject to disclosure under FOAA. If records or information that are subject to a privilege or designated confidential by statute are identified after the documents have been reviewed, a more specific explanation for the objection will be provided.

Please note that under FOAA, the Board only has an obligation to make available records in its possession or custody, and has no obligation to prepare reports, summaries, or compilations not in existence on the date of your request. The Board does not maintain records for some of the information you have requested, specifically Medicaid Identification Number, National Provider Identifier (NPI) number, Provider Specialty, or Provider Practice Location.

The Board can provide the address it has on record for a licensee, except for those that are confidential by statute. As the Board of Optometry addresses are not confidential by statute, I could provide them but caution you that they may not be responsive since they may reflect a home number and not the location of practice. Please clarify this request before I produce information regarding addresses of optometrists.

As to education/school/training, pursuant to 1 M.R.S. § 408-A(4), I object to and deny your request to the extent complying with this part of your request would require a search of individual files of licensees. There are thousands of active licensees in the categories you describe, and conducting a search for education/school/training by reviewing thousands of individual files would be unduly burdensome and oppressive.

The board has 25 credits of continuing education for each licensee for the past 9 years (or for the period of licensure, whichever is shorter) for each optometrist. When you asked for education and training, were you including continuing education?

Subject to and without waiving these objections, it is anticipated that the Board will produce the public records responsive to your request within two (2) weeks. Please feel free to contact me with any questions.

The providers listed are enrolled MaineCare providers (which is the term used for Medicaid in Maine). There is no separate MaineCare ID, MaineCare simply uses the NPI.
