Pursuant to the Wisconsin Open Records Act, I hereby request the following records:

-the total number of use of force incidents, separated by year and by type of force used from 2013-2019 (for example, "27 taser incidents in 2013, 3 baton incidents in 2013, etc.)
-total number of civilian complaints reported and the total number sustained, separated by year (for example, 8 complaints in 2013, 2 complaints sustained in 2013, 4 complaints in 2014, 1 complaint sustained in 2014, etc.)
-total number of use of force complaints reported and the total number sustained from 2013-2019, separated by year
-total number of biased policing or discrimination/profiling complaints reported and the total number sustained from 2013-2019, separated by year
-a spreadsheet or list with the dates (month/day/year and time if available), race of subjects involved, and injuries/deaths sustained for all officer-involved shootings incidents (excluding shootings of animals) from 2013-2019, separated by year

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Your request is received. The records you seek are either publically available currently or do not exist. I have tried to respond here in a fashion you can follow.

Your request 1. Use of Force data https://www.cityofmadison.com/police/data/

Your request 2.3.4. From 2013-2016 no such record exists; MPD did not put a document together that collected citizen complaints in a report fashion. For 2017 and 2018 however, this data was used to create the MPD Accountability Report https://www.cityofmadison.com/police/ 2019 data/report is not yet completed therefore, no record exists at this time.

Your request 5. No MPD records exists that are a "spreadsheet or list with the dates of Officer involved shooting/deaths". Wisconsin law requires all Office Involved Critical Incidents to be investigated by the Department of Justice, Division of Criminal Investigations. They are the keeper of these records which are also available to the public on their website. https://www.doj.state.wi.us/dci/officer-involved-critical-incident
The DCI reports date back to 2015, I have found no records prior to 2015 that are specifically organized as Office Involved Critical incidents records. I have however found a record that indicates in 2013 there were two Officer Involved Shootings and in 2014 there were two Officer Involved Shootings.

Under the Wisconsin Public Records Laws, records custodians must carefully weigh the competing public interests involved when deciding to release any record in their possession. Custodians begin with a presumption of complete public access to such records. However, custodians must consider whether inspection of the record could result in harm to the public interest that would outweigh the benefits of such inspection. When such harm substantially outweighs the benefits of public inspection, such records or portions thereof, must remain confidential.

For the portions of your request where no record exists. The Wisconsin Public Records Compliance Guide from the Wisconsin Department of Justice details how a Records Custodian must analyze a request and first determine if a record exists. Where noted above, no records exist. * "[T]he public records law does not require an authority to provide requested information if no record exists, or to simply answer questions about a topic of interest to the requester."141 "An authority is not required to create a new record by extracting and compiling information from existing records in a new format.142" 141 Journal Times, 2015 WI 56, ¶ 55 (citation omitted); see also State ex rel. Zinngrabe v. Sch. Dist. of Sevastopol, 146 Wis. 2d 629, 431 N.W.2d 734 (Ct. App. 1988). 142 See Wis. Stat. § 19.35(1)(L); see also George v. Record Custodian, 169 Wis. 2d 573, 579, 485 N.W.2d 460 (Ct. App. 1992)."

I have reached the above conclusions after weighing the reasons for nondisclosure against the public interest in disclosure and taking into consideration laws which either require or prohibit the release of certain records or information. For the reason(s) set forth above, I have concluded that the public interest in nondisclosure of the redacted information outweighs the public interest in disclosure. Pursuant to Sec. 19.35(4)(b) Wis. Stats., I advise you that this determination not to disclose the information described above is subject to review by Mandamus under Sec. 19.37(1) Wis. Stats., or upon application to the Wisconsin Attorney General or the Dane County District Attorney.
