Pursuant to the California Public Records Act, I hereby request the following records:

Contracts and invoices related to the use of communication services at any and all county correctional or detention facility locations under the jurisdiction of this agency. This may encompass telecommunication, kiosk, and mobile tablet services.

Please provide the following relevant materials.

• Any and all open or active Requests for Proposal or similar solicitations regarding the provision, installation, maintenance, or use of communication services. If available or applicable, please also provide equivalent materials for video conferencing equipment and other electronic communication and telecommunication services.

• Any and all active contracts regarding the provision, installation, maintenance, financial requirements, associated commissions, or use of communication services. Please include all associated supplemental materials, including any and all attachments, amendments, and exhibits. Please provide any other materials regarding the terms of service, including the term and expiration date of the current contract, as well as any optional contract extensions. Please include the name of the current telecommunication provider, as well as the services currently being provided pursuant to the agreement. Relevant companies include, but are not limited to, CenturyLink, City Tele Coin, ICSolutions, JPay, and Securus Technologies.

• Any and all financial reports, commission reports, revenue reports, and invoices related to the provision, installation, maintenance, or use of communication services. Please include all usage and fee reports, providing as much segregable data as possible, including, but not limited to, the rate at which the funds were generated, the revenue generated for each service, the timeframe during which the funds were generated, the nature of the communication's payment (collect, prepaid, inmate account), etc. If available, please also provide equivalent materials for video conferencing equipment and other electronic communication and telecommunication services.

Please provide all current contract materials and invoices for the period January 1, 2015 through the date this request is processed.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Dear Ms. Lipton:

I am writing on behalf of the County of Madera regarding your California Public Records Act request dated August 16, 2018, regarding "[c]ontracts and invoices related to the use of communication services at [the County jail]." Parts of the request seem unduly broad and confusing. I would like to discuss clarifying the request so that it is focused and effective in reasonably describing identifiable public records. The California Public Records Act requires the County to work with you to clarify the request where necessary. (Government Code section 6253.1.) Ordinarily I would have this conversation in a telephone call, but you have not provided a telephone number by which to reach you, and have stated that email is preferred. So, I am compelled to put these questions and concerns in writing. Please contact me directly if you wish to speak by phone.

In the meantime, your answers to the following questions will help focus the request so that the County can assist you in identifying possible responsive records. Specifically, one of the requests seeks:

Any and all financial reports, commission reports, revenue reports, and invoices related to the provision, installation, maintenance or use of communication services. Please include all usage and fee reports, providing as much segregable data as possible, including but not limited to the rate at which the funds were generated, the revenue generated for each service, the timeframe during which the funds were generated, the nature of the communication's payment, (collect, prepaid, inmate account), etc. If available, please also provide equivalent materials for video conferencing equipment and other electronic communication and telecommunication services.

"Any and all financial reports," etc. could include every monthly financial report the County generates related to accounts receivable or accounts payable for all of the County's services, even if it only includes a single line-item reference to the communications services subject to your request. Is your request intended to be so broad as to include the thousands of pages of financial reports and invoices generated annually, even where the reference to jail communications services is de minimis? Further, unlike the other two categories of records sought that are limited to "active" contracts and supplemental records, this one has no time limit bounding the records, which makes it overly burdensome and unduly costly to compile and provide the records.

In addition, when you refer to:

* "[S]egregable data" from the "usage and fee reports" to what are you referring specifically?

* "[T]he rate at which the funds were generated," are you referring to a rate over time (e.g., the total amount of funds generated over a year") or a rate at which fees and charges were computed (e.g., "inmates were charged $3 per minute for use of the service")?

* "The revenue generated for each service," for what period of time? During the entire term of the contract? Monthly? Annually? From the beginning when the County began offering such services?

* "[T]he timeframe during which the funds were generated," this is a question for you. For what timeframe are you seeking revenue data?

When the County receives clarification of these questions, it can begin searching for responsive records. Please advise at your earliest convenience.
