Pursuant to the Pennsylvania Right to Know Act, I hereby request the following records:

I request the reports to the police on a theft that took place on February 22nd at Sheetz on Cedar Cliff Dr. in Lower Allen , PA. I request any available dialogue between the Sheetz and the police regarding any theft that had taken place that night. I also would like to request any additional information about the subjects from the general public and Sheetz Employees themselves.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Dear Mr. Freedman, On September 15, 2022, you requested "I request the reports to the police on a theft that took place on February 22nd at Sheetz on Cedar Cliff Dr. in Lower Allen, PA. I request any available dialogue between the Sheetz and the Police regarding any theft that had taken place that night. I also would like to request any additional information about the subjects from the general public and Sheetz employees themselves."

After receiving and reviewing your request, we have determined this is a deniable request. Under the PA Right-To-Know Law, Section (16) A record of an agency relating to or resulting in a criminal investigation, including: (ii) Investigative materials, notes, correspondence, videos and reports, Section (16) (vi) A record that, if disclosed, would do any of the following: (A) Reveal the institution, progress or result of a criminal investigation, except the filing of criminal charges, Section 708 (30) A record identifying the name, home address or date of birth of a child 17 years of age or younger, are all deniable. What you have requested falls under these sections. There for your request is being denied.

If you choose to file an appeal, you must do so within 15 business days of the mailing date of the agency's response. This is in Section 1101 of the PA Right to Know Law. If you have further questions, please call Helen R. Grundon, Lower Allen Townships Right to Know Officer. I have placed a hard copy of your Right to Know request and your denial letter in the mail today. Please be advised that this correspondence will serve to close this record with our office as permitted by law.
