Robin,

Muckrock is not my website, it is a service I am using to facilitate the request and host responsive documents.

If you search for requests made to Louisville Metro through Muckrock, you’ll find several instances of requests being completed without the question of Muckrock’s funding model: https://www.muckrock.com/place/united-states-of-america/kentucky/louisville-jefferson-county/.

As stated in the original request, this request is not being made for commercial purposes.

Good morning,

I came across your response to Robin when I was looking for missed requests and I can’t tell if you’ve been responded to or not so I will explain why the request is being viewed as commercial one on our end.

On the Muckrock website’s about page<https://www.muckrock.com/about/> it mentions a $20 fee to file up to four requests (see attached). It appears that Muckrock is being paid to provide the record.

A Commercial Purposes request is defined, per KRS 61.870(4)(a), as “…the direct or indirect use of any part of a public record or records, in any form, for sale, resale, solicitation, rent, or lease of a service, or any use by which the user expects a profit either through commission, salary, or fee.”

That is why we feel that this is a commercial request.

Thank you and to be clear we do not have any issues with the content of Muckrock requests we are just under the impression that Muckrock is being paid to provide these records because of the $20 fee listed on the site and referenced in the attachment.
