Pursuant to the Kentucky Open Records Act, I hereby request the following records:

Copies of all Twitter Direct Messages sent to or from your agency's Twitter account (https://twitter.com/LMPD ). To clarify, I am requesting all Direct Messages retained within this account within at the time of this request.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 3 business days, as the statute requires.

To clarify, I am requesting all Direct Messages retained within this account within at the time of this request,' is denied pursuant to KRS 61.872(3)(b) which requires a requestor that lives or has their principal place of business outside of the county where they requested records are located to precisely describe records that are readily available. "A description is sufficiently precise for purposes of records access by mail if it describes the records in definite, specific and unequivocal terms." 13-ORD-077, p. 2, quoting 98-ORD-17. "A request must be 'specific enough so that a public agency can identify and locate the records in question." 18-ORD-068, p. 2, quoting 13-ORD-077, p. 3.

The LMPD does not have the resources to download the requested data and our obligation under the Kentucky Open Records Act is to provide records that are readily available, and not to conduct research. Fulfilling your request would require this agency to screen shot every direct message and then review them to make necessary personal privacy redactions such as names, phone numbers and other personal information. This research would take an extraordinary amount of time and thus, would be an unreasonable burden on this agency in order to comply.
