Pursuant to the the Louisiana Public Records Act, I hereby request the following records:

Documents concerning IMSI catchers or any of the following words: "Stingray", "cell site simulator", or "dirtbox". including:
-Contracts with the Harris Corporation regarding the acquisition of their Stingray or KingFish IMSI catchers
-Department policies and procedure regarding the use of IMSI catcher technology
-policies and procedures on the keeping of statistics about the Department's use and acquisition of IMSI catchers

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you for submitting a public records request to the Louisiana Department of Justice. You asked for documents concerning IMSI catchers or any of the following words: "Stingray", "cell site simulator", or "dirtbox" including:

* Contracts with the Harris Corporation regarding the acquisition of their Stingray or KingFish IMSI catchers;

* Department policies and procedure regarding the use of IMSI catcher technology;

* Policies and procedures on the keeping of statistics about the Department's use and acquisition of IMSI catchers.
After a diligent search and in consultation with the Louisiana Bureau of Investigation, it has been determined that any documents which pertain to these terms are investigative in nature. Release of this information would expose investigative techniques and security procedures, making these records subject to the exemption in La. R.S. 44:3(A)(3) and excepted from disclosure. The statute reads in pertinent part:

Nothing in this Chapter shall be construed to require disclosures of records, or the information contained therein, held by the offices of the attorney general, district attorneys, sheriffs, police departments... which records are: ... Records containing security procedures, investigative training information or aids, investigative techniques, investigative technical equipment or instructions on the use thereof..."

The records you seek contain security procedures and investigative techniques of the Attorney General. Accordingly, it is this office's position that the records requested are exempt, and we must respectfully decline to produce any responsive records at this time. I am happy to work with you on a new public records request, should you seek documents that are not exempted from disclosure.
