Pursuant to the California Public Records Act, I hereby request the following records:

all correspondence between members of the department via email and cellular text messages that contains references to the use of "aerial drones" or "drones" for the purpose of "surveillance", "crime intervention" or "crime prevention." This correspondence should be limited to correspondence that occurred between January 2016 and March 2022.

In order to help you determine my status for the purpose of assessing fees, you should know that I am a representative of Vice News organization and this request is made as part of news gathering and not for commercial
use.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 calendar days, as the statute requires.

Dear Requester:

With regards to your request for cellular text messages that “contains references to the use of ‘aerial drones’ or ‘drones’ for the purpose of ‘surveillance’, ‘crime intervention, ‘crime prevention.’”

We are asking you to clarify the scope or focus of this portion of your request due to the amount of time it would take to contact each individual employee, around 10,000 personnel, for responsive records. The Department has determined that the request would be unduly burdensome as interpreted in the "public interest" provision of Government Code Section 6255 of the California Public Records Act. The courts have interpreted this provision to include an exemption where production of the requested documentation would be unduly burdensome to the public agency involved. 

 

In order to conduct a more focused search, please identify which individuals, by name or serial number, you would like us to search our records for.

We ask that you respond to us by March 28, 2022, at the latest. 

 

With regards to the remainder of your request, we are still searching for, and/or identifying the requested records and appreciate your continued patience.

We have reviewed your California Public Records Act request. 

 

Please be advised that, pursuant to California Government Code Section 6253(c), we have found that “unusual circumstances” exist with respect to the request due to the need to search for, collect, and review the requested records from other Department entities which are separate from the office processing the request. Therefore, our staff will require the statutory fourteen days extension of time in which to respond. A determination concerning your request will be made as soon as possible.

Additionally, we are awaiting a response to our communication on March 14, 2022 regarding clarification on the cellular text portion of your request. Please respond to us no later than March 28, 2022.
