Pursuant to the California Public Records Act, I hereby request the following records:

With respect to any Twitter, Facebook, or Instagram account created, operated, or maintained by your agency:

1. A copy of the list of people, accounts, or pages banned by that account. This list is accessible by logging into the account as an administrator and:
(a) On Facebook, clicking "Settings" t the top of the official page, (C) clicking “People and Other Pages” in the left column, and (D) selecting “Banned People and Pages” from the drop-down menu. The final URL should look like: https://www.facebook.com/.../settings/?tab=people_and_other_pages.
(b) On Twitter, navigating to this URL while logged into the account: https://twitter.com/settings/blocked.
(c) On Instagram, follow these instructions: https://help.instagram.com/461525818338125/?helpref=uf_share.

2. A copy of the settings for the Facebook page. This list is accessible by (A) logging into the Facebook page as an administrator, and then (B) clicking “Settings” at the top of the official page. The URL should look like: https://www.facebook.com/.../settings/?tab=settings.

3. A copy of any policy concerning employee use of social media or use of your agency's social media accounts by the public.

These requests include, but are not limited to, the Facebook pages located at https://www.facebook.com/lapdhq and https://www.facebook.com/911LAPD and https://www.facebook.com/lapdwestla, the Twitter accounts @LAPDHQ, @911LAPD, @LAPDCentralArea, @LAPDPacific, @LAPDRampart, @NortheastArea, @LapdHarborDiv, @LAPDWestLA, @LAPDDevonshire, and @LAPDChiefMoore, and the Instagram account located at https://www.instagram.com/lapdhq.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

We reviewed your request for:

3. A copy of any policy concerning employee use of social media or use of your agency's social media accounts by the public.

Your request was made under the California Public Records Act (the Act). The Department is cognizant of its responsibilities under the Act. It recognizes the statutory scheme was enacted to maximize citizen access to the workings of government. The Act does not mandate disclosure of all documents within the government’s possession. Rather, by specific exemption and reference to other statutes, the Act recognizes that there are boundaries where the public’s right to access must be balanced against such weighty considerations as the right of privacy, a right of constitutional dimension under California Constitution, Article 1, Section 1. The law also exempts from disclosure records that are privileged or confidential or otherwise exempt under either express provisions of the Act or pursuant to applicable federal or state law, per California Government Code Sections 6254(b); 6254(c); 6254(f); 6254(k); and 6255.

With regards to #1 and #2 of your request, please be advised that, pursuant to California Government Code Section 6253(c), we have found that “unusual circumstances” exist with respect to the request due to the need to search for, collect, and review the requested records from other Department entities which are separate from the office processing the request. Therefore, our staff will require the statutory fourteen days extension of time in which to respond. A determination concerning your request will be made as soon as possible.

With regards to #3 of your request, a search was conducted, and the responsive records, not previously provided, have been provided to you. Please see a previous request for similar responsive records (see: https://lacity.nextrequest.com/requests/20-719), for policies concerning employee use of social media. Additionally, the main LAPD website contains the Department Manual (see: https://www.lapdonline.org/lapd-manual/), which can be used to research the relevant policies that are cited within the provided documents.

The Department asserts this exemption due to our belief that disclosure of this information to the public could interfere with the operations of the Department and does not serve the public interest.
